To the left of the main entrance, a door to the basement was also punched, a shed was made, first there was a cafe "Taj Mahal", then some kind of bar ... A staircase to the mezzanine leading to another firm was attached to the shed above the entrance to the bar on the right. The result is the disfigured facade of House 46.

Alexey Kovalev wrote that he received numerous appeals from the owners of premises in apartment buildings with complaints about the actions of regional interdepartmental commissions (MVK) for the approval of projects related to the arrangement of separate entrances to non-residential premises on the first floors, as well as in the basements and basements of apartment buildings ... Such separate (or additional) entrances, as a rule, are equipped on site. window openings in the transferred (option - planned for transfer) residential premises for the purpose of their commercial use ...

In accordance with the Rules for the maintenance and repair of facades of buildings and structures in St. Petersburg, actions related to the device or change appearance windows or entrances are allowed by agreement with the owners of buildings and structures.

Obtaining the consent of the owners actually requires both the Housing Code of the Russian Federation (article 36, subparagraph 3 of paragraph 1), and the Rules for the maintenance of common property in an apartment building, approved by Decree of the Government of the Russian Federation of 13.08.2006 No. 491. Since it says that bearing structures apartment building (including foundations, load-bearing walls load-bearing columns, etc.) belong to common shared ownership.

However, the district administrations, acting on behalf of St. Petersburg - the owner of premises in the same apartment building, a participant in the right to common shared ownership of common property, do not insist on the obligation to comply with these rules.

So, on January 20, 2012, the Vasileostrovsky District Court of St. Petersburg considered a civil case at the suit of one of the owners of the premises of the apartment building No. 37 on the 12th line of V.O. window opening in the front facade of the house. By a court decision, the stated requirements were denied. From the materials of the case it can be seen that the decision of the MVK to approve the project was made without the consent of all the owners of the premises of the house.

This example is extremely typical. Owners' complaints to district administrations in most cases remain unresolved, including with reference to part 2 of Article 40 Housing Code RF - although it has nothing to do with the case. The rule of this article states that when redevelopment and reconstruction of premises is carried out, the consent of the owners of the premises of an apartment building is not required, unless such a reconstruction is impossible without attaching part of the common property to them in an apartment building.

But the organization of separate entrances to the premises on the first floors is associated with the dismantling of the window-sill brickwork in the front capital walls, that is, it is an interference with the common property of the house.

From the answers of the officials of the district administrations, it is clear that neither they, nor the MEC of the districts consider the arrangement of separate entrances as an operation with the common property of an apartment building, and therefore projects of such work are coordinated by the MEC without the consent of other owners of the premises.

Even in the presence of decisions of the general meetings of the owners of the premises of apartment buildings on the refusal of the so-called. investors in the device of additional entrances and notification of such decisions of the district administrations, the latter still agree on the projects of the equipment of individual entrances.

As a result, Deputy Kovalev asked the governor to inform if he thought it necessary:

Organize a check and generalization of the practice of coordinating regional IAC projects related to the arrangement of individual entrances;

To amend the Regulations on the regional MVK, allowing them to coordinate such projects after receiving the decision of the general meeting of owners.

There is nothing to comment on except for one nuance.

On the one hand, we have the "Rules for the maintenance and repair of facades of buildings and structures in St. Petersburg", approved by the Decree of the Government of St. Petersburg dated 09.14.2006 No. 1135, according to which the actions in question are allowed in accordance with the design decision agreed with the owners buildings and structures.

On the other hand, the Regulations on the regional MVK, approved by the Decree of the Government of St. no structures required.

There seems to be a contradiction. In fact, there is no contradiction, and both documents should be applied together. For there is no such document that would abolish or limit the rights of owners.

But they pretend that the "Rules for the maintenance and repair of facades of buildings and structures in St. Petersburg" in such cases have nothing to do with it.

Vice Governor Kozyrev is responsible

Vice-Governor Sergei Kozyrev answered the deputy on behalf of the governor. His initial thesis is that the issues of transferring residential premises to non-residential premises are regulated by Art. 22 - 24 of the Housing Code (LC) of the Russian Federation, and an exhaustive list of documents is indicated in Art. 23. “Providing the consent of the owners of the premises, - stressed Kozyrev, - Art. 23 is not provided, therefore the requirement authorized body to provide such consent will be illegal. This is where the consent of the owners should be contained, since the "Rules for maintenance and repair ..." establish the procedure for the preparation and execution of projects, and this includes the consent of the owners.

So, in reality, everything is simple: Vice-Governor Kozyrev is trying in his response to defend the illegal practices of the regional MVK, administrations and courts. And here's what is curious: the power in the city has changed, and the war between officials and the people continues successfully old scheme.

Further, Sergey Kozyrev delved into the problem associated with Art. 36 and 40 of the Housing Code. In short, then it comes about the following. If the size of the common property of the owners of apartments in an apartment building does not decrease during the transfer of a residential premises to non-residential, then their consent for alterations is not required. But - Kozyrev emphasized, "if the reconstruction project provides for a separate entrance, and such a device is impossible without using the common property of the owners of premises in an apartment building, the consent of all owners for such a redevelopment and (or) reconstruction is not required."

At the same time, Mr. Kozyrev delicately overlooked the fact that the wall of the building is also always the common property of all owners of residential premises of an apartment building, and the transformation of a window opening into a doorway is certainly accompanied by the elimination of part of the wall. At first, Kozyrev simply bypassed this point, and then, referring to judicial practice, absurdly stated: "The device of a door from a window without its expansion cannot be interpreted as reconstruction."

Thus, the vice-governor Kozyrev argued in his answer that a door could be made from a window on the first floor of a house without widening the opening in the wall. Something I didn’t have to see, so that for the door to the store, created from a residential apartment on the first floor of the building, it was not necessary to enlarge the window opening.

In conclusion of his answer, Mr. Kozyrev wrote for some reason, stating that in accordance with clause 3.1.2 of the "Rules for the maintenance and repair of facades of buildings and structures in St. Petersburg" it is not required to obtain the consent of the owners of premises in an apartment building.
