  • designation of places where any public servitude is in effect.

The absence of certain information will require revision of the project, which may lead to a denial of its approval.

When it is necessary to justify the land-surveying project, then you should take the drawings, which primarily reflect the boundaries of the sites, the objects on them, as well as the protected areas. In most cases, it is the drawings that act as evidence, since they represent a display of the site in miniature, but with the preservation of all its characteristics.

In order to receive a project of a site, you must send an application to the appropriate structure. Today, there are two options, this is the administration of a particular settlement, which is possible not in any city, this should be clarified in a particular municipality, as well as special companies performing such work. In the case of a government body, you should contact the head of the department directly, and if the application is submitted to the company, it will be accepted by an authorized employee.

The application must always be accompanied by the terms of reference, which is issued to the applicant. Its form is established by the companies and bodies providing this service.

The initial stage in the preparation of the project is the collection of documents by the applicant himself. The required information includes:
  • it is necessary to obtain a complete analysis reflecting the condition of the soil in the area where the buildings will be erected;
  • research of the specifics of the existing architectural context;
  • analysis of the level of environmental safety of works to be carried out at the site;
  • documents confirming the availability of technical support for future work;
  • analysis of all construction results.

Based on the above information, the administration or the company accepting the applications draws up a decision to carry out cadastral works.

When making a decision on the part of an authorized entity, it is important to pay attention to the availability of a technical assignment, which will serve as the basis for planning and performing the necessary cadastral activities. It is issued exclusively by an authorized body or organization, after which it must be sent to specialists, namely cadastral engineers.

Only this group of persons can perform the work in question, since it has the necessary knowledge and skills. In addition, they have at their disposal the necessary equipment and other technical equipment.

The next stage is project development. If the city administration accepted the application for surveying, then it requests a cartographic image of the site, which is in the register of the information bank and has all the necessary designations of the current boundaries. On such documents, all lines of the boundaries of the survey, as well as important objects of the site, should be placed. In case of participation of a company operating under a license, it independently takes a copy of the cartographic image of the allotment and puts all the necessary marks on it.

If it is necessary to carry out any engineering networks, then in addition to the above information, situational plans for the placement of such communications should be obtained.

After the development of projects, it is imperative to go through the procedure for their approval. Regardless of who the performer is, the administration or the licensed company, the project can only be approved by submitting it to a public hearing, where it will be reviewed and evaluated. In addition to the project, an extract from the previously drawn up master plan for the development of the territory should be provided. Such hearings give permission for cadastral activities if the project meets all the requirements and contains comprehensive information. All documentation should be sent to the services for the supply of gas, water and electricity, if the project provides for the implementation of such communication networks.

The procedure for preparing boundary documents is carried out within the time limits established by law. If the administration is dealing with the issue, then the whole procedure takes about two months, since the procedure for obtaining a building permit takes half the time. When it comes to companies providing the service in question, here the period can be half as long. Everything will depend on the terms of the agreement, which details each stage of the entire process with the calculation of time and necessary costs.

The cost of the project will also differ from those situations when the authorized entity is the administration or a licensed company. If assistance is provided by an authority, it will be gratuitous. With regard to assistance from a licensed company, the cost of the work will be set according to the contract. Moreover, her responsibility includes only the preparation of the project, for which a fee is charged. Today, such a service can cost from thirty to four hundred thousand rubles. The price will depend on the volume and duration of the work.

Thus, a land survey project is a mandatory document that must reflect all the necessary characteristics of a land plot, from the area to an accurate image of the boundaries. It is always important to comply with the rules for the composition of project information, as well as the requirements for its design. Any violation entails the invalidity of the document and the need for revisions.

Its preparation can be carried out both by the authorities and by private companies, while the procedure as a whole will not have significant differences between the first and second options.

REQUIREMENTS for the land surveying project

I. General provisions

1. Requirements for the project of land surveying (hereinafter - Requirements) establish the rules for the design of a land survey project (hereinafter referred to as the Land survey project).

2. Land surveying project is prepared in respect of the land plot (land plots) allocated on account of the land share (land shares), taking into account the requirements of the Federal Law of July 24, 2002 No. 101-FZ "On the turnover of agricultural land".

3. The survey project is approved by:

1) by a decision of the general meeting of participants in shared ownership of a land plot (land plots) from agricultural land;
2) by the decision of the owner of the land share or land shares.

4. The land surveying project determines the size and location of the boundaries of a land plot or land plots that can be allocated at the expense of a land share or land shares (hereinafter - formed land plots).

The Land Survey Project, subject to approval by the decision of the general meeting of participants in shared ownership of a land plot (land plots) from agricultural land, also includes information on land plots allocated against land shares in municipal ownership (if any), and on land plot or land plots, the right of common ownership to which remains or arises.

5. The size of a land plot allocated against a land share or land shares is determined on the basis of the data specified in the documents certifying the right to this land share or these land shares in the manner prescribed by Article 13 of the Law on Turnover.

6. Land surveying project consists of text and graphic parts, which are divided into sections.

In cases stipulated by the Requirements, an application is included in the Land Survey Project.

7. The textual part of the Land Survey Project includes the following sections:

1) explanatory note;
2) initial data;
3) a list of owners of a land plot or land plots, from which the allocation of land plots is carried out on account of land shares (hereinafter - changed land plots);
4) information about the formed land plots and their parts;
5) information about the changed land plots and their parts;
6) information on ensuring access to the formed or changed land plots.
The textual part of the Land Survey Project also includes a title page and content.

8. The graphical part of the Land Survey Project includes the "Project Plan" section.

9. The survey project is completed in the following sequence: title page, content, sections of the text part, sections of the graphic part, appendix.

P. General requirements for the preparation of the Land Survey Project

11. The survey project is drawn up on paper in the amount of at least two copies.

At the request of the customer, the Land surveying project is additionally executed in the form of an electronic document.

12. The survey project must be stitched and sealed with the signature and stamp of the cadastral engineer. The signature and seal of the cadastral engineer are affixed on the title page of the Land Survey Project, on the Project Plan and on the back of the last page of the Land Survey Project.

13. Land surveying project is drawn up using computer graphics. When registering a Land Survey Project, a combined method can also be used. Entering textual information manually (by hand) is made legibly with ink, ink or blue paste. Typos, erasures, additions, crossed out words and other unspecified corrections are not allowed. All corrections in the Land Survey Project must be certified by a signature (indicating the surname and initials) and an imprint of the seal of the cadastral engineer.

Pencil design is not allowed. All records, with the exception of specified cases, are made in Russian. Numbers are written in Arabic numerals.

Land surveying project is drawn up on A4 sheets. Section "Project plan" can be made out on sheets of larger format.

14. The numbering of sheets of the Land Survey Project is continuous within the document. The documents included in the appendix are not numbered.

If the information does not fit on one sheet of any section, it is allowed to place it on several sheets or on the back of the corresponding sheet. In this case, the following information is reproduced on each sheet or on each page of the corresponding section: the words "Land Survey Project" and the name of the corresponding section of the Land Survey Project.

If the sections of the Land Survey Project are placed on sheets with a turnover, when filling in the "Sheet N ___" variable of the corresponding section of the Land Survey Project, the page number is additionally given, separated by commas.

The total number of sheets of the Land Survey Project, including the number of sheets of application documents, is indicated on the title page.

15. Unfilled details of the sections of the textual part of the Land Survey Project are not excluded; such details are marked with a "-" (dash) sign.

16. Land surveying project is drawn up on the basis of a cadastral extract of the corresponding land plot or a cadastral plan of the corresponding territory.

17. If necessary, for the preparation of the Land Survey Project, cartographic materials and (or) land management documentation stored in the state fund of data obtained as a result of land management can be used.

18. The Appendix of the Land Survey Project, approved by the decision of the owner of the land share or land shares, includes:

1) all objections received to the cadastral engineer who prepared the Land Survey Project regarding the size and location of the boundaries of the land share or land shares allocated for the land share or land shares (if any), drawn up in accordance with paragraph 13 of Article 13.1 of the Law on Turnover;
2) the conclusion of the cadastral engineer on the withdrawal of objections regarding the size and location of the boundaries of the land plot allocated against the land share or land shares (if there are objections specified in subparagraph 1 of this paragraph);
3) the conclusion of the cadastral engineer on the absence of objections regarding the size and location of the boundaries of the land plot allocated for the land share or land shares, presented in accordance with paragraphs 13 and 14 of Article 13.1 of the Law on Turnover (in the absence of objections specified in subparagraph 1 of this paragraph);
4) copies of documents, certified by a cadastral engineer, certifying the rights to a land share or land shares for which a land plot is allocated;
5) a copy of the notice of the need to approve the Land Survey Project, provided for in paragraph 10 of Article 13.1 of the Law on Turnover (if such a notice was sent to the participants in shared ownership);
6) a copy of the page of the printed publication containing a notice of the need for approval of the Land Survey Project, provided for in paragraph 10 of Article 13.1 of the Law on Turnover, and a copy of the first sheet containing the details of the print publication (if such a notice was published in the media defined by the subject of the Russian Federation).

19. The application of the Land Survey Project, approved by the decision of the general meeting of participants in the shared ownership of a land plot (land plots) from agricultural land, includes an act of the relevant local government body confirming the powers of an official of the local government body specified in paragraph 10 of Article 14.1 of turnover, or a duly certified copy of such an act.

20. In the conclusion of the cadastral engineer on the withdrawal of objections regarding the size and location of the boundaries of the land plot allocated for the land share or land shares, in the form of a coherent text, information about the person who submitted the corresponding objections, the reasons for his disagreement with the proposed size and location of the boundaries of the formed land plot, as well as information on how to eliminate such causes.

The conclusion of the cadastral engineer on the withdrawal of objections regarding the size and location of the boundaries of the land plot allocated for the land share or land shares shall be signed by the person who removed the previously submitted objections (indicating his last name, initials and the date of signing), and the cadastral engineer (indicating his last name, initials and date of signing). The signature of the cadastral engineer is certified by his seal.

What is a land survey project?

A land survey project is a document that defines the boundaries of the territory of a land plot. At the same time, there may be a capital structure on the territory. When a land survey project (PMT) is being prepared, the boundaries of allotments are established in accordance with the conditions of urban planning legislation and the requirements of Federal Law No.190, Article 43 of the Town Planning Code of the Russian Federation of December 29, 2004.

The project has fixed the marking of the area where the development is planned. The document defines the actions of developers during the construction of new facilities. If the site is to be divided into smaller parts, it also becomes necessary to draw up this document.

Who is doing PMT?

Design work is carried out by order of the administrative authorities by the following specialists:
  • local administration experts;
  • employees of the organization that performs land surveying (the company must have a license that allows them to engage in this type of activity).

Document structure

Requirements for the structure of the project of land surveying of a linear object are spelled out in clause 5 of article 43 of the Federal Law No. 190. Traditionally, the document should contain the following information:
  • Details of the plot of land.
  • Drawings indicating the allotments that border the described territory.
  • The list of costs for the registration of documentation, its preparation, for the implementation of the survey procedure.
The introductory part should contain:
  • explanatory note;
  • features of land surveying;
  • the tools that were used;
  • justification of decisions.
The first part contains a description of the object in which the survey was carried out:
  • the boundaries of the investigated territory;
  • its features;
  • measurements, calculations performed;
  • the result of the survey.
The second section of the project consists of drawings of the territory. They must necessarily be drawn lines that outline the boundaries of the allotment, the location of capital structures on the site, if any.

The structure of the graphic part contains:

  • plot boundaries, which are traditionally indicated by red lines;
  • indents from border lines - restrictions on the construction of buildings;
  • indication of the territory where the capital structure is located;
  • land on which new structures are being built;
  • areas for which a special order of use is established.

In some cases, the document also includes the boundaries of protected lands, which cannot be changed, since they are recognized as historical and cultural heritage.

Quarter land survey project

The document that is drawn up for the already built-up areas of the city is called the project of the quarter. It also indicates the boundaries, land area, directions of its use.

The dimensions of the territories around the houses are determined in accordance with the standards that existed at the time of building construction. In general, the pattern is as follows: the earlier a house is built, the fewer floors it has, and the greater the ratio of the adjacent territory to the squares of the living area.

The procedure for drawing up a land survey project

To create a land survey project, you need to contact the specialists who are engaged in this. There should be no mistakes in the document, because it is submitted to state authorities for subsequent registration.

The procedure for drawing up a project includes several stages:

  • The experts carry out all the necessary preparation for conducting land surveying. For this, all available documentation for this land is being studied.
  • On the basis of the studied papers, a drawing is drawn up with a marking of the boundaries.
  • The land survey procedure is being carried out.
  • Calculations are performed, area determination.
  • There are two parts of the project.

  • The land survey project is being approved.
The completed project must be approved by the local authorities of the settlement to which the territory belongs. After approval, public hearings are held, and at the end the project must be approved by the head of the district or region. As a result, the document is either approved or sent for revision.

In total, all these stages can take from three months to one year.

The cost of a land survey project

The cost of drawing up a document depends on the company where the customer applied, as well as on the location of the object. In rural areas, prices are several times lower than in cities. The following factors can also affect the cost increase:
  • the size of the territory;
  • unforeseen difficulties in collecting materials;
  • the use of expensive equipment;
  • the urgency of the work;
  • disputes with neighbors regarding the drawing of borders.


In rural areas, the prices for drawing up a project start at 500 rubles, in the city they vary from 5,000 to 500,000 rubles.

Changes to the project of land surveying

If technical errors are found in the project of land surveying, it is necessary to make changes to it. Also, amendments are possible in connection with the change in the purpose of the building existing on this land, with, restrictions or encumbrances applied to the site.

To make changes to the project, you need to submit an application to the administrative authorities. It must be reviewed within 30 days.

If a positive decision is made, a repeated survey is carried out and a new project is drawn up with the changes introduced. The reason for the refusal may be insufficient reasoning about the need for redesign.

What is a block survey project?

According to the Urban Planning Code adopted in our country, each land-surveying project must necessarily include land-surveying drawings with marked boundaries of sites, red lines, boundaries of zones where easements and other restrictions on land use are in effect.

You also need a list of existing, created and modified parcels of land, indicating the area of \u200b\u200beach of them and how it is allowed to use it.

If land surveying is carried out for a previously built-up quarter, then the size of the adjoining territories of multi-storey buildings is set in accordance with the norms that were relevant at the time of construction of these houses. These norms have existed since pre-revolutionary times, and in Soviet times they were gradually reduced. The general principle is as follows: the later the house is built and the greater its number of storeys, the less the adjacent territory relies on per square meter of living space.

Preparation and approval

The decision to write all kinds of urban planning documentation, including documents such as land surveying projects, is taken by the local government.

The development of a territorial planning project is a very time-consuming and expensive business, it requires the participation of highly qualified specialists, therefore city administrations usually do not do this on their own, but announce a competition among specialized design companies.

An exception is the case when there is an agreement either on the integrated development or on the development of a previously built-up area. In this case, the project is prepared by the company with which this agreement is concluded.

After the project is ready, it is submitted for public hearings (except in cases of integrated development of the urban area and two more situations that are rare in urban conditions). This is the only stage when residents can see the project and demand changes and additions to it.

To do this, you must not miss the notification of the hearings, get acquainted with the draft, formulate comments and enter them in the logbook. In this case, the city administration or its authorized body (in Moscow, these are city and district urban planning commissions) are obliged to consider the comments of residents. But the final decision - whether to approve the project, reject it or send it for revision - remains with the authority.

Example

Let us consider the scheme of land surveying of a quarter bounded by Balaklavsky Prospekt, Azovskaya Street, Chernomorsky and Simferopolsky boulevards in the Moscow district of Zyuzino. The sample is published on the website of the prefecture of the Southwestern District of Moscow at https://yadi.sk/i/iaVJpd48h9RNe.

The project was developed by JSC Mosproekt-2 named after Posokhin "in 2014. The customer is the Moscow City Property Department.

Substantiation materials include BTI data on buildings located within the block, ISCGD data on the zones of action of various restrictions, field research data on actual land use. The calculation of the required area of \u200b\u200bthe adjacent territories was carried out taking into account the standards that existed at the time when the quarter was built up, that is, from 1959 to the present day.

70 plots were formed, including the adjoining territories of 28 residential buildings. For six houses (three of which are newly built 24-storey towers), the adjacent territories turned out to be less than the required area.

For all houses, in addition to the normative land plots, plots with “minimum encumbrances” have been allocated. This practice, introduced by the Moscow government in defiance of federal law, is aimed at enabling residents (if they wish) to abandon the regulatory plots and thereby save on taxes.
