In accordance with Federal Laws dated May 4, 1999 N 96-FZ "On the protection of atmospheric air", dated January 10, 2002 N 7-FZ "On environmental protection", taking into account the protocol of the Coordination Council in the field of environmental protection in Khanty-Mansiysk Autonomous Okrug - Yugra dated June 30, 2011 N 2, in order to organize work to regulate emissions of pollutants into the air during periods of unfavorable meteorological conditions, the Government of the Khanty-Mansiysk Autonomous Okrug - Yugra decides:

Recommend to legal entities and individual entrepreneurs who have sources of emissions of pollutants into the air at approved standards for maximum permissible emissions, by April 1, 2012, to agree on measures to reduce emissions of pollutants into the air with the Service for Control and Supervision in the Sphere of Protection environment, wildlife and forest relations of the Khanty-Mansiysk Autonomous Okrug - Ugra.


1. This Procedure defines the rules for carrying out work to regulate emissions of pollutants into the air during periods of unfavorable meteorological conditions (hereinafter referred to as NMU) on the territory of the Khanty-Mansiysk Autonomous Okrug - Yugra (hereinafter referred to as the Autonomous Okrug).

2. Legal entities and individual entrepreneurs with emission sources are obliged to coordinate with the Service for Control and Supervision in the Sphere of Environmental Protection, Fauna Objects and Forest Relations of the Khanty-Mansiysk Autonomous Okrug - Ugra on measures to reduce emissions of pollutants into the air (hereinafter - Events) during the NMU period.

3. Regulation of emissions of pollutants into the atmospheric air during periods of NMD is carried out by legal entities and individual entrepreneurs with sources of emissions into the air, taking into account forecasts of the onset of NMR, as well as warnings about a possible dangerous increase in the concentration of pollutants in the atmospheric air.

4. Legal entities and individual entrepreneurs with sources of emissions of pollutants into the air:

receive information about NMU in accordance with the procedure established by the federal executive body performing the functions of normative legal regulation in the field of environmental protection;

carry out Activities agreed with the Service for Control and Supervision in the Sphere of Environmental Protection, Fauna Objects and Forest Relations of the Khanty-Mansiysk Autonomous Okrug - Yugra, taking into account compliance with the efficiency conditions, the specifics of specific production processes in the form established by the current legislation and other regulatory documents in the field of environmental protection and protection of atmospheric air. The measures are subject to revision in the event of a change in the production technology and the volume of emissions of pollutants into the atmospheric air;

carry out production control over the implementation of the Measures;

annually, before February 1 of the year following the reporting year, they submit information on the implementation of the Measures during the periods of the NMU and their effectiveness to the Service for Control and Supervision in the Sphere of Environmental Protection, Fauna Objects and Forest Relations of the Khanty-Mansiysk Autonomous Okrug - Yugra. If in the past year the periods of the IMT did not occur, the submission of such information is not required.

5. The Service for Control and Supervision in the Sphere of Environmental Protection, Fauna Objects and Forest Relations of the Khanty-Mansiysk Autonomous Okrug - Yugra, upon receipt of the information provided for by this Procedure, carries out:

control over the implementation of the Events and their effectiveness in accordance with the authority;

preparation and posting of information on the quality of atmospheric air and regulation of emissions during the NME period on its official website in the information and telecommunications network Internet.

Chapter 1 General Provisions

1. The procedure for carrying out work to regulate emissions of harmful (polluting) substances into the atmospheric air during unfavorable meteorological conditions (hereinafter referred to as the Procedure) has been developed in accordance with the legislation of the Russian Federation and the Sverdlovsk region in the field of atmospheric air protection in order to prevent threats to the life and health of the population during changes in the state of the atmospheric air, reducing the negative impact on the environment in urban and rural settlements of emissions of harmful (polluting) substances into the atmospheric air during periods of unfavorable meteorological conditions (hereinafter - NMU).

2. This Procedure defines the list, responsibilities and interaction of organizations involved in the regulation of emissions of harmful (polluting) substances into the air during periods of unfavorable meteorological conditions in the Sverdlovsk region, including the preparation and transmission of relevant forecasts.

3. NMM is understood as the meteorological conditions conducive to the accumulation of harmful (polluting) substances in the surface layer of atmospheric air.

4. Under the regulation of emissions of harmful (polluting) substances into the air is understood as their short-term reduction during the periods of NMV, leading to the formation of a high level of air pollution.

5. Regulation of emissions of harmful (polluting) substances into the atmospheric air is carried out taking into account the forecasts of the NMU on the basis of warnings about a possible dangerous increase in the concentration of harmful (polluting) substances in the atmospheric air.

Depending on the expected level of atmospheric air pollution, warnings of three degrees (first, second and third) are drawn up, which must correspond to three modes of operation of enterprises during the periods of NMS.

6. During the period of validity of warnings about a possible dangerous increase in the concentration of harmful (polluting) substances in the atmospheric air during periods of NMW, in order to prevent it, legal entities and individual entrepreneurs who have sources of emissions of harmful (polluting) substances into the atmospheric air are required to take measures to reduce emissions of harmful (polluting) substances into the atmospheric air.

7. Preparation of specialized information on the occurrence of NMUs in the Sverdlovsk region, contributing to air pollution, is carried out by the federal state budgetary institution "Sverdlovsk Center for Hydrometeorology and Environmental Monitoring with Regional Functions" (hereinafter - FSBI "Sverdlovsk TsGMS-R") in accordance with regulatory and methodological documents of the Federal Service for Hydrometeorology and Environmental Monitoring.

Chapter 2. Procedure for the development and approval of activities

to reduce emissions of harmful (polluting) substances

into the atmospheric air during the periods of NMU

8. Legal entities and individual entrepreneurs with sources of emissions of harmful (polluting) substances into the atmospheric air, develop measures to reduce emissions of harmful (pollutants) substances into the atmospheric air during periods of NMW (hereinafter referred to as activities at IMM) and a schedule for monitoring harmful emissions (pollutants) into the atmospheric air during the periods of NME as part of the draft standards for maximum permissible emissions of harmful (polluting) substances into the atmospheric air (hereinafter referred to as the draft MPE), in accordance with the regulatory and methodological documents of the Federal Service for Hydrometeorology and Environmental Monitoring (in part development of measures to reduce emissions) and the Federal Service for Supervision of Natural Resources.

9. Legal entities and individual entrepreneurs who have sources of emissions of harmful (polluting) substances into the air, coordinate the developed measures under the NMU with the Ministry of Natural Resources of the Sverdlovsk Region.

10. The development of measures at the NMU is carried out for both existing and projected objects of economic activity. Measures at the NMU are subject to revision when the production technology and the volume of emissions of harmful (pollutants) into the atmospheric air change.

11. Local self-government bodies of municipalities in the Sverdlovsk region, on the territory of which NMUs are forecasted, develop measures under the NMU within the limits of their powers.

12. Measures at the NMU are an obligatory part of the consolidated volume "Atmosphere protection and maximum permissible emissions (MPE)" for the territory of urban and other settlements and their parts.

Chapter 3. The procedure for communicating warnings about IMM and interaction during the IMM period

13. Bringing warnings about NMU to the executive bodies of state power authorized in the field of environmental protection on the territory of the Sverdlovsk region, local self-government bodies of municipalities in the Sverdlovsk region, legal entities and individual entrepreneurs having sources of emissions of harmful (polluting) substances on the territory of the Sverdlovsk region , and interaction during the periods of NMM is carried out in accordance with the Scheme for communicating warnings about NMU and interaction of the Department of Rosprirodnadzor for the Ural Federal District, the Ministry of Natural Resources of the Sverdlovsk Region, the FSBI "Sverdlovsk TsGMS-R", local self-government bodies of municipalities in the Sverdlovsk region, legal entities and individual entrepreneurs who have sources of emissions of harmful (polluting) substances into the atmospheric air in the territory of the Sverdlovsk region, when carrying out work to regulate emissions of harmful (polluting) substances into the atmosphere air during the periods of NMU on the territory of the Sverdlovsk region (Appendix 1).

14. The list of executive bodies of state power authorized in the field of environmental protection in the territory of the Sverdlovsk region and local self-government bodies of municipalities in the Sverdlovsk region, subject to notification of the occurrence of NMU, is given in Appendix 2.

15. The list of legal entities and individual entrepreneurs, which, as part of the draft MPE standards, approved measures at the NMU, agreed with the Ministry of Natural Resources of the Sverdlovsk Region, obliged to carry out these measures in the event of an NMD on the territory of the Sverdlovsk Region, is determined by the Department of Rosprirodnadzor in the Ural Federal District and is provided by requests in accordance with applicable law.

16. The preparation of warnings about an increase in the level of air pollution in connection with the expected NMD (hereinafter - warnings), their transmission and cancellation is carried out by the FSBI "Sverdlovsk TsGMS-R".

17. FSBI "Sverdlovsk TsGMS-R" provides specialized information on the emergence of NMU on the territory of the Sverdlovsk region to the executive bodies of state power authorized in the field of environmental protection on the territory of the Sverdlovsk region, local self-government bodies of municipalities in the Sverdlovsk region, legal entities and individual entrepreneurs, having sources of emissions of harmful (polluting) substances on the territory of the Sverdlovsk region and obliged to take measures to reduce emissions of harmful (pollutants) substances into the air during the periods of NME, within the framework of joint programs (agreements), as well as under contracts for information support services in the manner established by applicable law.

18. The text of the transmitted warning of the FGBU "Sverdlovsk TsGMS-R" indicates the time of the onset and end of the NMU period, the degree of warning and the mode of operation of the enterprise (first, second, third).

19. Legal entities and individual entrepreneurs, who, as part of the draft MPE standards, approved measures at the NMU, agreed with the Ministry of Natural Resources of the Sverdlovsk Region, by order of the head of the enterprise approve the procedure for receiving warnings and switching over to the specified operating modes during NME periods, indicating the persons responsible for carrying out events at the NMU for the enterprise, production facilities, workshops, sites, other objects, as well as persons responsible for organizing the reception and transmission of warnings about NMU, who, having accepted the text of the warning about NMU, register it in a special log (Appendix 3) and immediately bring it to information of persons responsible for holding events at the NMU in the divisions of the enterprise.

The measures taken to reduce the emissions of harmful (polluting) substances into the atmospheric air at NMU are indicated in the journal (Appendix 3).

20. Local self-government bodies of municipalities in the Sverdlovsk region, subject to notification of the onset of NMU, organize work to reduce emissions of harmful (polluting) substances into the air during NME periods within the limits of their authority, including carrying out wet cleaning of streets, restrict loading - unloading works;

upon receiving warnings about NMD of the second and third degree, inform the population about the occurrence of NMD through the media and ask them not to set fire to garbage, use public transport and other recommendations.

Chapter 4. Monitoring the implementation of mitigation measures

emissions of harmful pollutants into the air

21. Legal entities and individual entrepreneurs, which, as part of the draft MPE standards, approved measures under the NMU, agreed with the Ministry of Natural Resources of the Sverdlovsk Region, exercise production control over the effectiveness of measures to reduce emissions of harmful (polluting) substances into the air during the periods of NME in accordance with a plan-schedule for monitoring emissions of harmful (polluting) substances into the atmospheric air during the periods of NME;

submit to the Department of Rosprirodnadzor in the Ural Federal District and a report on the implementation of measures at the NMU, confirmed by the results of instrumental measurements.

22. The Department of Rosprirodnadzor for the Ural Federal District and the Ministry of Natural Resources of the Sverdlovsk Region, when organizing and conducting state control over the protection of atmospheric air, monitor the conduct and effectiveness of measures at the NMU.

23. FSBI "Sverdlovsk TsGMS-R" and the Ministry of Natural Resources of the Sverdlovsk Region carry out state monitoring of atmospheric air during the periods of NMU. The monitoring results are published in the annual state report on the state and protection of the environment in the Sverdlovsk region.

24. The Ministry of Natural Resources of the Sverdlovsk Region quarterly publishes on the website of the Ministry of Natural Resources of the Sverdlovsk Region www. ***** information on the state of atmospheric air during the periods of NMU according to the monitoring of atmospheric air on the regional observation network.

2. For the purposes of this Procedure, the basic concepts established by Article 1 of the Federal Law of 04.05.1999 No. 96-FZ "On the Protection of Atmospheric Air" are used.

3. This Procedure is mandatory for all legal entities and individual entrepreneurs who have sources of emissions of harmful (polluting) substances into the air (hereinafter referred to as emission sources),at objects of economic and other activities,subject to regional state environmental supervision.

4. Bodies of local self-government of municipalities of the Ulyanovsk region carry out the organization, and the executive bodies of state power of the Ulyanovsk region, territorial bodies of federal executive bodies in the field of environmental protection and territorial bodies of other federal executive bodies carry out the organization and control of work to regulate emissions of harmful (polluting ) substances into the atmospheric air during the periods of IMU.

5. The regulation of emissions is carried out taking into account the forecast of the NMR on the basis of warnings about a possible dangerous increase in the concentration of impurities in the air in order to prevent it.

Forecasting the level of air pollution in the Ulyanovsk region is carried out in accordance with the legislation of the Russian Federation by the Ulyanovsk Center for Hydrometeorology and Environmental Monitoring - a branch Federal State Budgetary Institution "Volga Department of Hydrometeorology and Environmental Monitoring"(hereinafter referred to as the authorized body).

Depending on the expected level of atmospheric air pollution (forecast), the authorized body draws up warnings about a possible dangerous increase in the concentration of impurities in the air, indicating three degrees of danger, determined in accordance with the Methodological Guidelines.

6. Warnings about expected NMWs are transmitted to state bodies specified in Appendix No. 2 to this Resolution, to legal entities, individual entrepreneurs with emission sources, in accordance with the legislation of the Russian Federation on information services in the field of hydrometeorology.

7. When receiving forecasts of NMM, legal entities, individual entrepreneurs with emission sources are obliged to take measures to reduce emissions of harmful (polluting) substances during periods of NMM (hereinafter referred to as measures), depending on the degree of warning about expected NMR in accordance with the approved action plans.

8. Measures during the periods of NMW are developed by legal entities, individual entrepreneurs with emission sources.

9. Action plans are developed as part of the draft standards for maximum permissible emissions, approved by the head of a legal entity or another authorized person, an individual entrepreneur and agreed with the territorial body of the federal executive body in the field of environmental protection, which ensures control over the conduct and effectiveness of these measures.

10. The development of measures during the periods of NMS is carried out for both existing and projected objects of economic activity.

If the production technology and the volume of emissions of harmful (polluting) substances into the atmosphere change, the measures are subject to mandatory revision.

11. When developing and implementing measures, the following principles and conditions are taken into account:

effectiveness of measures;

the specifics of specific production processes;

reduction of production is allowed in exceptional cases when the implementation of measures to reduce emissions does not lead to a decrease or stabilization of the level of pollution and there is a further intensive accumulation of harmful (polluting) substances in the surface layer, posing a threat to the life and health of the population.

12. To receive warnings about NMW, legal entities, individual entrepreneurs with emission sources appoint responsible persons who, after accepting the text of the warning, register it in a special log and inform the units and industries that regulate emissions of the need to take measures to reduce emissions into the atmosphere. air.

13. Production control and state environmental supervision are carried out over the implementation of measures during the periods of NMS.

Production control over the implementation of activities during the periods of NMS is carried out by legal entities and individual entrepreneurs in accordance with the approved schedules.

State environmental supervision over the implementation of measures is carried out in accordance with the legislation of the Russian Federation in the field of environmental protection and atmospheric air, taking into account the provisions of the Federal the law dated 26.12.2008 No. 294-FZ "On the protection of the rights of legal entities and individual entrepreneurs in the implementation of state control (supervision) and municipal control."

Control of the efficiency of reducing emissions of harmful (polluting) substances into the atmospheric air during the periods of NMD is carried out using instrumental or other methods permitted by the relevant regulatory documents.

Article 7. Information products for children under the age of six

Information products for children under the age of six may include information products containing information that does not harm the health and (or) development of children (including information products containing episodic non-naturalistic images justified by its genre and (or) plot or a description of physical and (or) mental violence (with the exception of sexual violence), provided that good triumphs over evil and expresses compassion for the victim of violence and (or) condemnation of violence).

Article 8. Information products for children who have reached the age of six

Information products for children who have reached the age of six years old can be classified as information products provided for in Article 7

1) short-term and non-naturalistic images or descriptions of human diseases (with the exception of serious diseases) and (or) their consequences in a form that does not humiliate human dignity;

2) non-naturalistic depiction or description of an accident, accident, catastrophe or non-violent death without demonstrating their consequences, which may cause fear, horror or panic in children;

3) episodic images or descriptions of these actions and (or) crimes that do not encourage the commission of antisocial actions and (or) crimes, provided that their admissibility is not substantiated or justified and a negative, condemning attitude towards the persons committing them is expressed.

Article 9. Information products for children who have reached the age of twelve

Information products for children who have reached the age of twelve years old can be classified as information products provided for in Article 8 of this Federal Law, as well as information products that contain justified by their genre and (or) plot:

1) episodic images or descriptions of cruelty and (or) violence (with the exception of sexual violence) without a naturalistic depiction of the process of deprivation of life or injury, provided that compassion for the victim and (or) negative, condemning attitude towards cruelty, violence (with the exception of violence used in cases of protecting the rights of citizens and the interests of society or the state protected by law);

2) an image or description that does not encourage the commission of antisocial actions (including the consumption of alcoholic and alcohol-containing products, beer and drinks made on its basis, participation in gambling, vagrancy or begging), occasional mention (without demonstration) of narcotic drugs, psychotropic and (or) intoxicating substances, tobacco products, provided that the admissibility of antisocial actions is not justified and not justified, a negative, condemning attitude towards them is expressed and an indication of the danger of consumption of these products, means, substances, products is contained;

Article 10. Information products for children who have reached the age of sixteen

Information products for children who have reached the age of sixteen years old may include information products provided for in Article 9 of this Federal Law, as well as information products that contain justified by their genre and (or) plot:

1) an image or description of an accident, accident, catastrophe, illness, death without a naturalistic demonstration of their consequences, which can cause fear, horror or panic in children;

2) an image or description of cruelty and (or) violence (with the exception of sexual violence) without a naturalistic depiction of the process of deprivation of life or injury, provided that compassion is expressed for the victim and (or) a negative, condemning attitude towards cruelty, violence (except for violence applied in cases of protection of the rights of citizens and the interests of society or the state protected by law);

3) information about narcotic drugs or about psychotropic and (or) intoxicating substances (without their demonstration), about the dangerous consequences of their consumption with the demonstration of such cases, provided that a negative or condemning attitude towards the consumption of such drugs or substances is expressed and an indication of the danger of their consumption;

4) certain swear words and (or) expressions that are not related to obscene language;

5) not exploiting interest in sex and not bearing an offensive depiction or description of sexual relations between a man and a woman, with the exception of depicting or describing actions of a sexual nature.
