  • The boiler may be the source of the problem. In the absence of a check valve, hot water from the boiler will flow into the cold water riser, due to a decrease in pressure when one of the neighbors uses cold water, or if they forget to close the taps at the inlet or outlet of the boiler when the tap on the hot water riser is open . If the boiler is constantly connected to the network, then in the event of an overflow, there will be hot water from the boiler in the cold water supply pipes, and, as a result, electricity costs may increase significantly.

What needs to be done

Check the cold water meter. It must not reverse. If, nevertheless, it is spinning, then it is necessary to close the tap on the riser, if the movement has stopped, then you definitely have a problem and you need to find a mixer or device that squeezes hot water.

  1. If there are no water meters, turn off the tap on the hot water riser, open cold water in the mixer and wait until the hot water stops flowing. Drawing up an application for recalculation

An act or other documents that confirm that you have not been at your place of residence for some time cannot be the basis for recalculating payment for water supply. They can only be used as an attachment to the application.

Important! There is no special form for such an application, therefore it is drawn up in a free form with the obligatory elements:

  • recipient data: name of the organization and official in whose name the application is written;
  • information about the applicant: full name, personal account number, residential address and telephone number;

Appeal to the judiciary

The court in which an application is submitted for the recalculation of payment for water supply to the management company will depend on the value of the claim. If the value of the claim does not exceed fifty thousand rubles, then the claim is filed with the justice of the peace, and when the amount of the claim exceeds this mark, then the case will be under the jurisdiction of the district court.

There is no clear form for filing a claim with the court, but there are requirements that it must comply with in accordance with Article 131 of the Civil Procedure Code of the Russian Federation.

  • name of the court, plaintiff and defendant (contact details and residential address). In this case, the applicant is an individual, and the defendant is a legal entity;

The claim is accepted for proceedings within five days after its filing with the court. If the claim is not accepted for proceedings, it means that it is returned to the plaintiff with a ruling on refusal to accept the statement of claim for proceedings.

Violations that are indicated in the ruling on refusal to accept the statement of claim must be eliminated, and after that the claim is filed again with the court. The execution of a court decision can be executed voluntarily or with the help of bailiffs, that is, forcibly.

In accordance with consumer protection law, claims aimed at protecting consumer rights are not subject to state duty. It must be paid only if the value of the claim is one million rubles or more.

What the law says

The legislation of the Russian Federation establishes certain requirements for the temperature regime of hot water supply, which is supplied to residents of an apartment building.

Remember! The quality requirements for the temperature regime of hot water are established by two official documents:

  • rules for the provision of public services to owners and users of premises in apartment buildings and residential buildings. They are approved by the Government of the Russian Federation of May 6, 2011, Resolution No. 354;
  • SanPiN 2.1.4.2496-09 "Hygienic requirements for ensuring the safety of hot water supply systems", approved on 04/07/2009.

Looking at these documents, we can conclude:

  • the temperature regime of hot water supply in the places of water intake should not be lower than 60 degrees Celsius and not higher than 75 degrees Celsius, regardless of which heat supply system is used in an apartment building;
  • to determine the temperature of hot water supply, water must be drained for 3 minutes and no more.

Permissible deviations in the temperature of hot water supply:

  • from 0.00 to 5.00 hours, that is, at night - no more than 5 degrees Celsius;
  • from 5.00 to 0.00 hours, that is, in the daytime - no more than 3 degrees Celsius.

The legislation establishes the following: if the requirements for hot water do not meet, then payment is not made in the amount that the resource supply organization requires:

  • during the period when the temperature of hot water is below 40 degrees Celsius, payment is made as for cold water supply;
  • during the period when the temperature of hot water supply is below 60 degrees Celsius, but above 40 degrees Celsius, the payment should be reduced.

The decrease occurs as follows: deviation from the normal temperature regime for every 3 degrees reduces the amount of payment for hot water supply by 0.1% per hour in which the decrease was recorded.

Why hot water is cold

We have determined the legislative framework, and now we need to find out for what reason a violation of the requirements for the temperature regime of hot water supply may occur.

The first reason for the occurrence of a violation of the temperature regime is a problem in the house itself.
