The Government of the Russian Federation decides:
1. To approve the accompanying changes that are made to the rules for the provision and distribution of subsidies from the federal budget to the budgets of the constituent entities of the Russian Federation to the provision of residential premises to orphans and children who remain without parental care, persons from their number under contracts for hiring specialized residential premises approved by the Government Decree Of the Russian Federation of December 31, 2009 N "On approval of the rules for the provision and distribution of subsidies from the federal budget to the budgets of the constituent entities of the Russian Federation to the provision of residential premises to orphans and children left without parental care, persons from their number under contracts for hiring specialized residential premises" (Meeting of the legislation of the Russian Federation, 2010, N 3, Art. 327; 2011, N 3, Art. 545; N 31, Art. 4764; 2012, N 3, Art. 447; N 32, Art. 4566; N 53, Art. 7945; 2014, N 12, Art. 1281; 2015, N 3, Art. 575).

Residential premises
1. In paragraph 3:
a) in subparagraph "a" words "minimum volume" to replace the word "volume";
b) add subparagraph "w" of the following content:
"G) Returns by the subject of the Russian Federation funds to the federal budget in accordance with paragraph 16 of the rules of formation, the provision and distribution of subsidies from the federal budget to the budgets of the constituent entities of the Russian Federation, approved by Decree of the Government of the Russian Federation of September 30, 2014 N" On the formation, provision and distribution Subsidies from the federal budget budgets of the constituent entities of the Russian Federation "(hereinafter referred to as the rules for the formation, granting and distribution of subsidies).".
2. Paragraph 3 (2) shall be amended as follows:
"3 (2). 5. In paragraph 8 (1):

6. Paragraph 8 (3) shall be amended as follows:
"8 (3). Agreement of changes in the agreement providing for the deterioration of the indicator of the effectiveness of the use of a subsidy is not allowed, unless the implementation of the conditions for granting the subsidy turned out to be impossible due to the circumstances of force majeure, changes in the values \u200b\u200bof target indicators and indicators of state programs of the Russian Federation, and Also in case of substantial (more than 20 percent) reduction of the size of the subsidy. ".
8. Subparagraph "b" of paragraph 9 shall be amended as follows:
b) compliance with the expenditures due to the subsidy established in accordance with paragraph 3 (2) of these rules of the limit level of co-financing the consumables of the constituent entity of the Russian Federation from the federal budget. ".
9. Paragraph 9 (1) shall be amended as follows:
"9 (1). The transfer of the subsidy is carried out in the prescribed manner on the basis of an application provided for in paragraph 7 (1) of these Rules, on accounts opened by the territorial bodies of the Federal Treasury in the establishments of the Central Bank of the Russian Federation for accounting of operations with the funds of the budgets of the constituent entities of the Russian Federation." .

12. Clause 12 shall be amended as follows:
"12. 13. Clause 13 shall be amended as follows:
"13. In order to increase the reliability of gas supply in the Russian Federation, in accordance with the Decree of the President of the Russian Federation of April 28, 1997 No. 426 "On the main provisions of structural reform in the spheres of natural monopolies" (Meeting of the legislation of the Russian Federation, 1997, No. 18, Art. 2132) The Government of the Russian Federation decides:
1. To approve the accompanying gas supply rules in the Russian Federation.
2. To recognize the decision of the Government of the Russian Federation of December 30, 1994 No. "On Approval of the Rules of Gas Supplies to Consumers of the Russian Federation" (Meeting of the legislation of the Russian Federation, 1995, No. 2, Art. 152).
Gas Supply Rules in the Russian Federation
I. General provisions
1. These rules determine the relationship between suppliers and gas buyers, including gas transmission organizations and gas distribution organizations, and are required for all legal entities involved in gas supply relations through pipeline networks.
2. The supplier, gas transmission and gas distribution organizations and the Gaza Buyer are obliged to strictly comply with the rules for technical operation and safety in order to ensure reliable gas supply and rational use of gas.
II. Terms and Definitions
3. These rules apply the following terms and definitions:
"gas" - natural, petroleum (passing) and replaced dry gases produced and collected by gas-imaging organizations and generated by gas-imaging plants;
"Armor of gas consumption" - the minimum amount of gas consumption required for trouble-free, subject to maximum use of reserve fuels, the operation of technological equipment of buyers, gas supplies that in accordance with the laws and other regulatory legal acts of the Russian Federation cannot be discontinued or reduced below a certain limit;
"Gas distribution organizations" - specialized republican, regional, regional, urban, interdistrict, rural organizations engaged in the development and operation of gas supply systems of territories, providing gas buyers, as well as providing gas transportation services on their networks;
"Gas Transport Organization" - providing gas transportation Organization in which the main gas pipelines and gas pipelines are owned or on other legal grounds;
"Gas Transport System" - gas pipeline system connecting gas and consumer manufacturers, including trunk gas pipelines, gas pipelines, gas distribution networks located at a gas transmission, gas distribution organization or buyer owned or on other legal grounds;
"Non-Child Gas" - the selection (receipt) by the gas buyer in the amount of less daily gas supply rate in the event that the gas pressure provided by the supplier at its transfer site gave the buyer to select (obtain) gas in the established volume contract;
"Gas overrun" - the selection of the gas buyer in the amount of a more daily delivery rate;
"Settlement period" - The period agreed by the parties for which the amount of gas should be determined, satisfied between the supplier, gas transportation, gas distribution organizations and the buyer for the supplied gas. The estimated period agreed by the parties is indicated in the contract;
"The average daily gas supply" - the volume of gas supply, determined by dividing the monthly amount of delivery by the number of days of the relevant month;
"Daily gas supply rate" - the average daily gas supply rate or the norm established by the dispatch schedule or agreement of the parties;
"Gas Transportation" - Moving and transferring gas according to the gas transmission system.
III. Procedure for concluding contracts
4. Before the use of gas as a fuel, the buyer must perform the technical conditions for attaching to the gas distribution system of gas-wide equipment. Technical conditions for connecting to the gas transmission and gas distribution system are issued by a gas transmission or gas distribution organization, respectively.
The costs associated with connecting the objects of the Supplier and the Gas Buyer to the Gas Transport System are produced by their account.
5. The supply of gas is made on the basis of an agreement between the supplier and the buyer concluded in accordance with the requirements of the Civil Code of the Russian Federation, federal laws, these rules and other regulatory legal acts.
The gas supply contract must comply with the requirements of paragraph 3 of chapters 30 of the Civil Code of the Russian Federation.
Gas balance in the Russian Federation is developed and approved by the Ministry of Energy of the Russian Federation in coordination with the Ministry of Economic Development of the Russian Federation on the basis of gas resources and the forecast of the needs of Russian consumers in fuel and energy resources. Gas balance in Russia is wearing advisory nature for suppliers and buyers.
In the case of establishing individual buyers of the minimum amount of gas consumption in accordance with the procedure established by the legislation of the Russian Federation in the contract at the request of such a buyer, the volume of gas supply is not less than this minimum level.
Gas supply to persons providing services for the formation of a promising technological reserve for electricity production facilities in accordance with the Decree of the Government of the Russian Federation of December 7, 2005 No. 738, is carried out on the basis of an agreement with the gas supplier concluded for a period of no less validity of the agreement on the provision of Services for the formation of a promising technological reserve for electrical energy production facilities, unless otherwise established by the Agreement of the Parties.
5.1. To conclude a gas supply agreement (with the exception of gas supply contracts concluded at organized trading), the applicant who has intent to speak by the Buyer on such a contract, has the right to contact the supplier with a gas acquisition application, which indicates the full and abbreviated name of the legal entity (surname, name , patronymic of an individual entrepreneur), bank details, the estimated period and the date of the start of the gas supply, the number and location (name) of the connection points and the gas- supply equipment for each of them, requested to supply the volume of gas for the entire estimated period of the contract (or annual gas volume) With a breakdown by months and quarters for each or for all connectivity points.
Copies are attached to the gas acquisition application:
constituent documents of a legal entity or passport of an individual entrepreneur;
certificates of state registration of a legal entity or certificate of state registration of an individual as an individual entrepreneur;
documents confirming the powers of persons to sign a contract on behalf of the buyer;
documents confirming the belonging of gas-grade equipment (gas supply objects) to the applicant on the right of ownership or on another legitimate basis, and technical passports on the indicated equipment;
act on connecting (technological connection) or an act on the attachment of an object to gas distribution networks, according to which gas can be supplied to the applicant. If the connection (technological connection) of the specified object is made before the decree of the Government of the Russian Federation dated February 13, 2006 No. 83 "On approval of the rules for determining and providing technical conditions for connecting the object of capital construction to the networks of engineering and technical support and the rules for connecting the capital construction object to the networks of engineering and technical support, "these documents are attached to the application for the purchase of gas if available;
documents confirming that the proportion of heat energy supply to budgetary institutions, whose activities are funded from the relevant budget based on the estimates of income and expenses, government enterprises, householders, housing, housing, housing and other specialized consumer cooperatives, managers or individual entrepreneurs carrying out the management of apartment buildings in the total volume of goods supplied by the buyer and the services provided is more than 75 percent (submitted to the subjects of heat supply with the indicated share of the supply of thermal energy);
a document confirming the establishment of armople's armople.
Copies of the documents provided for in this clause are certified by persons issued (compiled) such documents or a person authorized in accordance with the legislation of the Russian Federation to perform actions to assign copies of such documents.
Application for the purchase of gas and documents attached to it (subject to their compliance with the requirements of this clause) are considered by the supplier within 30 days from the date of their receipt. At the specified 30-day term, the provider sends a proposal to conclude a gas supply agreement (signed by the Supplier's draft agreement) or a written motivated refusal to enter into its conclusion.
6. The preemptive right to conclude gas supply contracts have gas supplies for state needs, for public utilities and the population, as well as buyers who have concluded gas supply contracts earlier - to the prolongation of these treaties.
7. The buyer or gas supplier has the right to transport it in accordance with the provisions on ensuring the access of independent organizations to the Gazprom open joint-stock company's gas transmission system and the gas distribution networks approved by the Government of the Russian Federation.
8. The procedure and conditions for transporting gas under the gas transmission system are established by a gas transmission or gas distribution organization and are issued by the Treaty in accordance with these Rules.
9. The proposal to conclude a gas supply agreement is sent to the supplier to the buyer who has previously submitted an application for the purchase of gas.
10. The proposal to conclude a gas transportation contract is sent by a gas transmission or gas distribution organization to the supplier (buyer) simultaneously with permission to access the gas transportation system issued in accordance with the procedure established by the Government of the Russian Federation.
11. Consent to the conclusion of the gas supply contract or gas transportation contract (signed draft agreement) should be directed by the Party that received a proposal to conclude an agreement (offer), no later than 30 days from the date of its receipt, unless otherwise determined in the offer.
In disagreement with the terms of the contract, the party who received an offer is obliged to send the other party the Differences Protocol, in the event of a disagreement of disagreements signed by the Supplier, to contact the Arbitration or Arbitration Court and after the expiration of the contract concluded for the previous period, Stop gas selection.
Selection (continued selection) of gas by the buyer after the expiration of the specified 30-day term and (or) the term of the agreement concluded for the previous period, is considered the consent of the part of the parties to the offer, to conclude a gas supply contract (transportation) on a supplier (gas transportation or gas distribution organization ).
If the buyer appealed to the Arbitration Court, the Agreement of Gas Supplies concluded for the previous period is extended until the entry into force of the court decision.
11.1. Supply (selection) of gas without a contract concluded in the manner prescribed by these Rules is not allowed. This gas selection is recognized as unauthorized (unauthorized).
IV. Conditions, deadlines and procedures for execution of contracts
12. The supplier is obliged to deliver, and the buyer to select gas in the amount defined in the gas supply contract.
12.1. In the contract of supply of gas, monthly, quarterly and annual volumes of gas supply and (or) are determined by the procedure for their approval, as well as the procedure for changing certain gas supply to the volume of gas supply.
13. The supplier is obliged to deliver, and the buyer to obtain (select) gas is evenly within a month within the amount established by the average daily gas supply of gas, and if necessary, the dispatching schedule has agreed between the parties (including the owners of the gas transmission system).
The non-uniformity of gas supply throughout the day is allowed within the month in cases provided for by the Treaty.
In the gas supply contract, which provides for uneven gas supply throughout the day during the month, minimum and maximum daily gas supply volumes should be determined. At the same time, the minimum daily volume of gas supply should not be more than 20 percent lower, and the maximum daily gas supply volume should not be more than 10 percent above the average daily gas supply rate. This rule does not apply to gas supply contracts concluded at organized trading.
Unless otherwise provided by the agreement between the supplier and the buyer, agreed by the contract, the uneven supply of gas supply on days does not entail an appropriate change in the monthly contractual volume of gas supply.
The provisions of this point on uniformity and unevenness (including the minimum and maximum daily volumes) of gas supplies are not applied to the contractual volumes established by the dispatch schedule.
14. At the request of the buyer, the uneven gas supply over time within a month is envisaged to the gas supply contract in the following cases:
the second paragraph has lost strength according to the Decree of the Government of the Russian Federation of November 25, 2016 No. 1245 ;
if the supply of gas is carried out for public utilities, for boiler and thermal power plants in volumes that ensure the need for the thermal energy of public utilities and the public;
if the supply of gas is carried out for generating facilities, using which services in the electric power industry turns out to form a promising technological reserve for electrical energy production facilities in accordance with the Decree of the Government of the Russian Federation of December 7, 2005 No. 738 and in respect of which in accordance with the legislation of the Russian Federation The amount of electrical energy is determined, mandatory for production with uneven graphs of their loading during the day.
15. During gas overruns by the buyer, the supplier has the right to conduct a compulsory limitation of its supply to the established daily gas supply rate after 24 hours from the moment of warning about this buyer and executive authorities of the constituent entities of the Russian Federation.
16. Installation of gas does not give the buyer the right to demand an increase in gas supplies over a daily rate.
When gas is not reflected by buyers who consume up to 10,000 thousand cubic meters. Gas meters per year, in accordance with the prisoners of gas supply contracts, the volume of non-liberated gas is not paid and sanctions for non-government gas are not provided.
A similar rule in relation to the buyer for gas without failure under gas supply contracts concluded on organized trading can be established in these contracts.
17. During gas overrun, without prior approval with the supplier, a gas transmission or gas distribution organization, the Buyer pays additionally the amount of gas selected in excess of the established contract and the cost of its transportation for every day using the coefficient:
This rule does not apply to gas volumes consumed by the population and utility consumers.
Other rule in relation to the buyer for gas overruns can be established in gas supply contracts concluded at organized trading, or in gas supply contracts for natural gas, mined by Public Joint-Stock Company Gazprom and its affiliates and implemented organizations for the production of natural gas in liquefied state or organizations that concluded gas supply contracts after November 1, 2018, providing for the beginning of the supply of natural gas after January 1, 2020, for the production of methanol of natural gas in a gaseous state for subsequent exports.
The duty on timely providing the provider of documentary confirmation provided for by this paragraph the grounds for non-separation of coefficients to the value of the relevant volume of gas and its transportation is assigned to the buyer.
18. The gas supply and transportation contracts are maintained by gas pressure supported under the condition of its customer within the daily gas supply rate.
19. The executive authorities of the constituent entities of the Russian Federation affirm charts:
consumer translations for backup types of fuel when cooling and the procedure for entering these charts into action to ensure the execution of a state contract for the supply of gas for state needs, export contracts for international obligations, gas supply contracts for public utilities and the population;
restrictions on the supply of buyers gas and the sequence of their disconnection in the event of a violation of the technological mode of operation of the gas transmission system during the accident.
Instructions for the introduction of the mentioned graphs and the appropriate change in the daily volume of the transmitted gas to buyers gives the central production and dispatch department of the Open Joint-Stock Company Gazprom.
Such instructions of the Central Production and Dispatch Department of the Open Joint Stock Company Gazprom on the mode of transportation, supply and selection of gas are mandatory for suppliers, gas transmission and gas distribution organizations and gas buyers.
The procedure for the preparation of the instructions on the implementation of the mentioned schedules is approved by the Ministry of Energy of the Russian Federation.
During the period of action for individual subjects of the Russian Federation of the said schedules, the supply of gas into these subjects of the Russian Federation under gas supply contracts concluded at organized trading can be suspended before the abolition of said schedules.
20. In the absence of a supplier, the capabilities of the direct supply of gas, the buyer of the supply contract is determined by the Party concluding gas transportation contract with gas transmission (gas transportation) and (or) gas distribution organizations.
V. Accounting Gaza
21. Supply and gas selection without taking into account its volume are not allowed.
22. Accounting for gas volume is carried out in the manner approved by the Ministry of Energy of the Russian Federation.
The gas transportation contract for gas transmission and gas distribution organization may be assigned duties and authority to receive and ensure the accounting of the supplied gas on behalf of the Supplier (Buyer). The supplier (buyer), which concluded a gas transportation agreement, notifies the counterparty.
23. In terms of malfunction or absence of measurement tools in the transmission side, the volume of transmitted gas is taken into account by the measurement measurements of the receiving gas measurements, and in their absence or malfunction - in terms of gas consumption, the corresponding design capacity of uncomclosed gas consumption and time during which was supplied Gas during malfunction of measuring instruments, or other method provided by the contract.
24. Installation, operation and verification of measuring instruments are made in the manner established by the legislation of the Russian Federation on ensuring the unity of measurements.
25. Responsibility for the technical condition and the verification of gas metering tools are carried by the Organization to which the measuring instruments belong.
26. Each of the parties to the gas supply contract or the gas transportation contract is obliged to provide the representative of the other party the possibility of checking at any time of the measurement tools, the availability of existing certificates of their verification, as well as documents on the accounting and use of gas by the buyer.
27. The item has lost its strength according to the Decree of the Government of the Russian Federation of July 23, 2015 No. 741.
28. The Party leading to the Gaza accounting in accordance with the procedure approved by the Ministry of Energy of the Russian Federation, monthly, to the fifth number of the month following the calculated period, is an act on the volume of transmitted gas, which reflects the daily volume of gas transmission.
With disagreement of one of the parties with the determination of the volume of transmitted gas, it signs the act, presenting a special opinion.
If there are differences, the party has the right to apply to the court.
Prior to the decision of the court, the volume of transmitted gas is established in accordance with the testimony of measuring instruments of the gas transmitting gas.
Vi. Calculations for gas and its transportation
29. Gas prices and its transportation rates are indicated in relevant treaties in accordance with the legislation of the Russian Federation and the regulatory legal acts of the federal executive authorities.
30. Supply and gas selection are carried out exclusively on a reimbursable basis in accordance with the contract concluded.
The procedure for calculations and terms of payments are determined by gas supply agreements in accordance with these Rules.
In contracts under which suppliers are gas distribution organizations, the following mandatory conditions for gas settlements should be contained:
enrollment of funds from gas distribution organizations for the supplied gas for specially discovered transit accounts of these organizations;
the transfer of funds credited to special transit accounts of gas distribution organizations, minus the amounts of allowance of gas distribution organizations, on the current accounts of their suppliers no later than the day following the day of receipt of funds for these transit accounts.
31. The terms of payment for gas transportation are determined by the gas transportation contract on the basis of tariffs for its transportation established in the manner defined by the federal executive bodies.
VII. Rights and obligations of the parties under the contract
32. Parties are fulfilling contractual obligations in accordance with the Civil Code of the Russian Federation, other laws and legal acts of the Russian Federation and these Rules.
33. The gas distribution organization is obliged to immediately implement a complete limitation of gas supply to the consumer, whose networks have direct access to the networks of the specified gas distribution organization (gas transporter), in case of detection of an emergency and the threat of life and (or human health caused by the unsatisfactory state of the consumer's gasual equipment.
34. The supplier has the right to reduce or completely discontinue the supply of gas to customers (but not lower than the armomation armor) in the event of a repeated violation of the terms of payment for the supplied gas and (or) for its transportation, with the exception of consumers, the list of which is approved by the Government of the Russian Federation.
The decision to terminate the supply of gas is valid until the establishment of the circumstances that were the basis for making such a decision.
35. The supplier is obliged to ensure the quality of gas in accordance with regulatory requirements.
36. Gas odoring is made in accordance with regulatory and technical documentation.
37. The supplier, gas transmission and gas distribution organizations and the buyer are responsible in the prescribed manner responsibility for the technical condition of the gas supply facilities belonging to them and compliance with operational dispatch discipline.
38. The supplier, gas transmission and gas distribution organizations and the buyer are obliged to immediately communicate each other about accidents and faults at gas supply facilities leading to a violation of the supply regime or gas reception.
39. The gas distribution organization submits at the request of the supplier operational information on gas consumption mode and payment status for supplied by buyers of gas.
40. The gas transmission organization is at the request of the gas distribution organization operational information on the volume and gas supply modes for each gas distribution station.
VII.1. The procedure for determining buyers, obliged to provide the fulfillment of obligations to pay for gas supplied under the gas supply contract concluded with the supplier and the procedure for providing such
40.1. The buyer must provide a provider to ensure the fulfillment of gas supply obligations supplied under the gas supply contract if the buyer has not fulfilled or improperly fulfilled the obligations to pay gas to the supplier and this led to the education of debt to the gas supply supplier in the amount equal to the double size of the average monthly value of the obligations Buyer for gas pay or exceeding such a double size.
In determining the compliance of the buyer (with the exception of the heat supply organization), the criterion established by paragraph the first of this clause is taken into account of the debt before the provider of gas pay, confirmed by the court decision or recognized by the Buyer.

Documents indicating the recognition by the buyer of debt to the supplier are the documents in which the explicit consent of the buyer is concluded with the fact of debt to the supplier and with the size of such debts (agreement between the supplier and the buyer, the act of reconciliation of mutual settlements, a letter signed by the buyer's authorized person or other document).
In order to apply these rules, the average monthly value for gas payment obligations (p obligs) is determined by the supplier by the formula:
S post - the cost of gas specified in the accounts for payment of actually consumed gas or in other payment documents issued by the supplier to the buyer for the estimated periods for which the buyer has formed the debt declared in paragraph of this paragraph to the supplier, confirmed by the court decision or recognized by the buyer;
n - the number of months in the period for which the cost of gas (s post) is determined and for which the buyer has formed the debt in the present paragraph of this paragraph before the supplier, confirmed by the court decision or recognized by the Buyer.
40.2. The supplier determines the buyer corresponding to the first paragraph of these rules provided by paragraph, and sends him a notice of duty to provide the fulfillment of gas payment obligations in a manner to confirm the fact and date of receipt of the notice.
The notice of the duty to provide ensuring the fulfillment of obligations to pay for gas is sent within a period not exceeding 6 months from the day of the arrears in the existence of which, in accordance with paragraph of these Rules, the Buyer must provide the provider to ensure the fulfillment of the fulfillment of gas payment obligations.
The specified notification must contain the following information:
the amount of the debt of the buyer, which served as the basis for the provision of the requirement to ensure the fulfillment of obligations, the calculation of the specified amount of debt and the average monthly value of the buyer's obligations to pay gas;
the magnitude of ensuring the fulfillment of obligations to pay gas to be subject to the buyer to the Supplier;
the deadline for which the provision of fulfillment of obligations to pay for gas should be provided;
the period during which it is necessary to provide ensuring the fulfillment of obligations to pay for gas.
40.3. The magnitude of ensuring the fulfillment of obligations to pay for the gas to be submitted by the Buyer, who complies with the first paragraph of these rules provided for by paragraph, is determined by the supplier and cannot exceed the amount of the debt of the buyer for paying gas, which served as the basis for providing claims to ensure the provision of commitments.
40.4. The buyer corresponding to the first paragraph of these rules provided for by paragraph is obliged to provide the Supplier to ensure the fulfillment of gas payment obligations for a period defined by the supplier. This period may not exceed 6 months from the date of the provision of liabilities.
40.5. The deadline for which it is necessary to provide the fulfillment of liabilities to pay for gas, is determined by the supplier, while the expiration date of the specified period cannot occur earlier than 60 days from the date of receipt by the Buyer notice of the duty to provide the fulfillment of the fulfillment of gas payment obligations.
40.6. Ensuring the fulfillment of obligations to pay for gas is provided by the Buyer, which corresponds to the first paragraph of these Rules provided for by paragraph and is determined by the supplier, in the form of an independent warranty by the Bank, which meets the requirements of the legislation of the Russian Federation (hereinafter - the bank guarantee).
The bank guarantee ensures the fulfillment of the duties arising after it are issued for gas supply supplied under gas supply contracts.
In coordination with the supplier, the buyer may be provided with a state or municipal guarantee or fulfillment of liabilities for gas payments can be provided with other ways provided by law or contract.
The provision of ensuring the execution of liabilities for gas payment is not required if before the expiration provided for by paragraph of the seventh paragraph of these Rules, the obligations to pay for gas, the failure or improper execution of which was the basis for the emergence of the buyer the obligations to provide the fulfillment of the obligations fulfilled in full.
40.7. In the event that the banking guarantee provided by the Buyer meets the requirements of the Federal Law "On Gas Transportation in the Russian Federation" and these Rules or if the fulfillment of the fulfillment of obligations to pay for gas complies with the method and conditions for ensuring the fulfillment of obligations agreed between the Supplier and the Buyer, as well as the requirements of the law or Agreement, supplier no later than 3 working days from the date of receipt of a bank guarantee (other provision of fulfillment of payment obligations) sends a notice to the Buyer about its adoption of a way to confirm the fact and date of receipt of the notice.
If the provided bank guarantee does not satisfy the requirements of the Federal Law "On Gas supply in the Russian Federation" and these Rules, the supplier on the period provided for by paragraph of the first paragraph, sends a notice to the Buyer notification of the defendant provided by the bank guarantee, indicating the reason for the failure to confirm the fact and Date receipt of notification.
In the event that the fulfillment of the fulfillment of liabilities for payment of gas does not meet the method and conditions for ensuring the fulfillment of obligations agreed between the supplier and the buyer, as well as the requirements of the Law or Agreement, the supplier on the period provided by paragraph of the first paragraph, sends a notice to the buyer about the failure to ensure the provision Executions indicating the reason for non-disabilities to confirm the fact and date of receipt of the notification.
40.8. The supplier prepares suggestions for the formation of a list of buyers, with respect to which gas suppliers have the obligation to ensure the fulfillment of obligations to pay for the supplied gas.
These proposals must contain the following customer information:
full and abbreviated (if) names of a legal entity, its address, the taxpayer identification number and the reason for the formulation of a legal entity for accounting in the tax authority in accordance with the information contained in the Unified State Register of Legal Entities;
surname, name and patronymic (if any) of an individual entrepreneur (individual), a taxpayer identification number in accordance with the information contained in the Unified State Register of Individual Entrepreneurs (in the presence of such information);

40.9. the date of receipt by the Buyer notice of the obligation to provide ensuring the fulfillment of obligations.
The absence in the indicated list posted in the Internet information and telecommunications network, information about the buyer, corresponding to the first paragraph of these rules provided by paragraph, does not relieve such a buyer from the obligation to ensure the fulfillment of the fulfillment of gas payment obligations at the request of the Supplier.
40.10. b) surname, name, patronymic (if any), date of birth, place of residence of the head and (or) of another official official of the buyer (with such information);
c) the contract in which the buyer has violated obligations to pay for gas;
d) entered into force court decisions confirming the availability of buyer's debt, and (or) documents confirming recognition by the buyer of debt to the supplier;
e) the accounts for payment of gas or other payment documents, in connection with the non-payment of which the buyer has a debt that served as the basis for its obligations to provide ensuring the fulfillment of obligations;
e) a certificate signed by an authorized person of the Supplier and confirming the lack of full payment of debt, which serves as a basis for the duty notice to provide the fulfillment of obligations, and the fact of failure to provide this provision within the prescribed period, and (or) other documents confirming the fact of non-fulfillment by the buyer of the obligation to provide provision fulfillment of liabilities for gas payment;
g) a notice of responsibilities to provide ensuring the fulfillment of obligations to pay for gas or the information contained in this notice;
h) documents confirming the fact and date of receipt by the Buyer notice of the obligation to provide ensuring the fulfillment of obligations to pay for gas;
and) documents confirming the powers of the person to sign the application.
VIII. Responsibility for violation of these rules
41. The supplier, gas transmission and gas distribution organizations and the buyer are responsible for violation of these Rules in accordance with the legislation of the Russian Federation and the Treaty.

I. General provisions
1. These rules determine the relationship between suppliers and gas buyers, including gas transmission organizations and gas distribution organizations, and are required for all legal entities involved in gas supply relations through pipeline networks.
2. The supplier, gas transmission and gas distribution organizations and the Gaza Buyer are obliged to strictly comply with the rules for technical operation and safety in order to ensure reliable gas supply and rational use of gas.
II. Terms and Definitions
3. These rules apply the following terms and definitions:
"gas" - natural, petroleum (passing) and replaced dry gases produced and collected by gas-imaging organizations and generated by gas-imaging plants;
"Armor of gas consumption" - the minimum amount of gas consumption required for trouble-free, subject to maximum use of reserve fuels, the operation of technological equipment of buyers, gas supplies that in accordance with the laws and other regulatory legal acts of the Russian Federation cannot be discontinued or reduced below a certain limit;
"Gas distribution organizations" - specialized republican, regional, regional, urban, interdistrict, rural organizations engaged in the development and operation of gas supply systems of territories, providing gas buyers, as well as providing gas transportation services on their networks;
"Gas Transport Organization" - providing gas transportation Organization in which the main gas pipelines and gas pipelines are owned or on other legal grounds;
"Gas Transport System" - gas pipeline system connecting gas and consumer manufacturers, including trunk gas pipelines, gas pipelines, gas distribution networks located at a gas transmission, gas distribution organization or buyer owned or on other legal grounds;
"Non-Child Gas" - the selection (receipt) by the gas buyer in the amount of less daily gas supply rate in the event that the gas pressure provided by the supplier at its transfer site gave the buyer to select (obtain) gas in the established volume contract;
"Gas overrun" - the selection of the gas buyer in the amount of a more daily delivery rate;
"Settlement period" - The period agreed by the parties for which the amount of gas should be determined, satisfied between the supplier, gas transportation, gas distribution organizations and the buyer for the supplied gas. The estimated period agreed by the parties is indicated in the contract;
"The average daily gas supply" - the volume of gas supply, determined by dividing the monthly amount of delivery by the number of days of the relevant month;
"Daily gas supply rate" - the average daily gas supply rate or the norm established by the dispatch schedule or agreement of the parties;
"Gas Transportation" - Moving and transferring gas according to the gas transmission system.
III. Procedure for concluding contracts
4. To use gas as a fuel, the buyer must have a permit, which is issued in the manner prescribed by the Government of the Russian Federation. The technical conditions for connecting to the gas transmission system are issued by a gas transmission or gas distribution organization, in the presence of a mentioned permit.
These documents are the basis for the design of gas supply of newly under construction, expandable, reconstructed and existing organizations and installations.
The costs associated with connecting the objects of the Supplier and the Gas Buyer to the Gas Transport System are produced by their account.
The contractual gas supply volumes should not exceed the volumes indicated in the use permit.

4. Before the use of gas as a fuel, the buyer must perform the technical conditions for attaching to the gas distribution system of gas-wide equipment. Technical conditions for connecting to the gas transmission and gas distribution system are issued by a gas transmission or gas distribution organization, respectively.
The costs associated with connecting the objects of the Supplier and the Gas Buyer to the Gas Transport System are produced by their account.
5. The supply of gas is made on the basis of an agreement between the supplier and the buyer concluded in accordance with the requirements of the Civil Code of the Russian Federation, federal laws, these rules and other regulatory legal acts.
The gas supply contract must comply with the requirements of paragraph 3 of chapters 30 of the Civil Code of the Russian Federation.
Gas balance in the Russian Federation is developed and approved by the Ministry of Energy of the Russian Federation in coordination with the Ministry of Economic Development of the Russian Federation on the basis of gas resources and the forecast of the needs of Russian consumers in fuel and energy resources. Gas balance in Russia is wearing advisory nature for suppliers and buyers.
In the case of establishing individual buyers of the minimum amount of gas consumption in accordance with the procedure established by the legislation of the Russian Federation in the contract at the request of such a buyer, the volume of gas supply is not less than this minimum level.

Copies of the documents provided for in this clause are certified by persons issued (compiled) such documents or a person authorized in accordance with the legislation of the Russian Federation to perform actions to assign copies of such documents.
Application for the purchase of gas and documents attached to it (subject to their compliance with the requirements of this clause) are considered by the supplier within 30 days from the date of their receipt. At the specified 30-day term, the provider sends a proposal to conclude a gas supply agreement (signed by the Supplier's draft agreement) or a written motivated refusal to enter into its conclusion.
6. The preemptive right to conclude gas supply contracts have gas supplies for state needs, for public utilities and the population, as well as buyers who have concluded gas supply contracts earlier - to the prolongation of these treaties.
7. The buyer or gas supplier has the right to transport it in accordance with the provisions on ensuring the access of independent organizations to the Gazprom open joint-stock company's gas transmission system and the gas distribution networks approved by the Government of the Russian Federation.
8. The procedure and conditions for transporting gas under the gas transmission system are established by a gas transmission or gas distribution organization and are issued by the Treaty in accordance with these Rules.
9. The proposal to conclude a gas supply agreement is sent to the supplier to the buyer who has previously submitted an application for the purchase of gas.
10. The proposal to conclude a gas transportation contract is sent by a gas transmission or gas distribution organization to the supplier (buyer) simultaneously with permission to access the gas transportation system issued in accordance with the procedure established by the Government of the Russian Federation.
11. Consent to the conclusion of the gas supply contract or gas transportation contract (signed draft agreement) should be directed by the Party that received a proposal to conclude an agreement (offer), no later than 30 days from the date of its receipt, unless otherwise determined in the offer.
In disagreement with the terms of the contract, the party who received an offer is obliged to send the other party the Differences Protocol, in the event of a disagreement of disagreements signed by the Supplier, to contact the Arbitration or Arbitration Court and after the expiration of the contract concluded for the previous period, Stop gas selection.
Selection (continued selection) of gas by the buyer after the expiration of the specified 30-day term and (or) the term of the agreement concluded for the previous period, is considered the consent of the part of the parties to the offer, to conclude a gas supply contract (transportation) on a supplier (gas transportation or gas distribution organization ).

12. The supplier is obliged to deliver, and the buyer to select gas in the amount defined in the gas supply contract.

13. The supplier is obliged to deliver, and the buyer to obtain (select) gas is evenly within a month within the amount established by the average daily gas supply of gas, and if necessary, the dispatching schedule has agreed between the parties (including the owners of the gas transmission system).
The non-uniformity of gas supply throughout the day is allowed within the month in cases provided for by the Treaty.
In the gas supply contract, which provides for uneven gas supply throughout the day during the month, minimum and maximum daily gas supply volumes should be determined. At the same time, the minimum daily volume of gas supply should not be more than 20 percent lower, and the maximum daily gas supply volume should not be more than 10 percent above the average daily gas supply rate. This rule does not apply to gas supply contracts concluded at organized trading.
Unless otherwise provided by the agreement between the supplier and the buyer, agreed by the contract, the uneven supply of gas supply on days does not entail an appropriate change in the monthly contractual volume of gas supply.
The provisions of this point on uniformity and unevenness (including the minimum and maximum daily volumes) of gas supplies are not applied to the contractual volumes established by the dispatch schedule.
14. At the request of the buyer, the uneven gas supply over time within a month is envisaged to the gas supply contract in the following cases:

15. During gas overruns by the buyer, the supplier has the right to conduct a compulsory limitation of its supply to the established daily gas supply rate after 24 hours from the moment of warning about this buyer and executive authorities of the constituent entities of the Russian Federation.
16. Installation of gas does not give the buyer the right to demand an increase in gas supplies over a daily rate.
When gas is not reflected by buyers who consume up to 10,000 thousand cubic meters. Gas meters per year, in accordance with the prisoners of gas supply contracts, the volume of non-liberated gas is not paid and sanctions for non-government gas are not provided.
A similar rule in relation to the buyer for gas without failure under gas supply contracts concluded on organized trading can be established in these contracts.
17. During gas overrun, without prior approval with the supplier, a gas transmission or gas distribution organization, the Buyer pays additionally the amount of gas selected in excess of the established contract and the cost of its transportation for every day using the coefficient:
This rule does not apply to gas volumes consumed by the population and utility consumers.
Other rule in relation to the buyer for gas overruns can be established in gas supply contracts concluded at organized trading, or in gas supply contracts for natural gas, mined by Public Joint-Stock Company Gazprom and its affiliates and implemented organizations for the production of natural gas in liquefied state or organizations that concluded gas supply contracts after November 1, 2018, providing for the beginning of the supply of natural gas after January 1, 2020, for the production of methanol of natural gas in a gaseous state for subsequent exports.
The duty on timely providing the provider of documentary confirmation provided for by this paragraph the grounds for non-separation of coefficients to the value of the relevant volume of gas and its transportation is assigned to the buyer.
18. The gas supply and transportation contracts are maintained by gas pressure supported under the condition of its customer within the daily gas supply rate.

The procedure for the preparation of the instructions on the implementation of the mentioned schedules is approved by the Ministry of Energy of the Russian Federation.
During the period of action for individual subjects of the Russian Federation of the said schedules, the supply of gas into these subjects of the Russian Federation under gas supply contracts concluded at organized trading can be suspended before the abolition of said schedules.
20. In the absence of a supplier, the capabilities of the direct supply of gas, the buyer of the supply contract is determined by the Party concluding gas transportation contract with gas transmission (gas transportation) and (or) gas distribution organizations.

21. Supply and gas selection without taking into account its volume are not allowed.
22. Accounting for gas volume is carried out in the manner approved by the Ministry of Energy of the Russian Federation.
The gas transportation contract for gas transmission and gas distribution organization may be assigned duties and authority to receive and ensure the accounting of the supplied gas on behalf of the Supplier (Buyer). The supplier (buyer), which concluded a gas transportation agreement, notifies the counterparty.

24. Installation, operation and verification of measuring instruments are made in the manner established by the legislation of the Russian Federation on ensuring the unity of measurements.
25. Responsibility for the technical condition and the verification of gas metering tools are carried by the Organization to which the measuring instruments belong.
26. Each of the parties to the gas supply contract or the gas transportation contract is obliged to provide the representative of the other party the possibility of checking at any time of the measurement tools, the availability of existing certificates of their verification, as well as documents on the accounting and use of gas by the buyer.

28. The Party leading to the Gaza accounting in accordance with the procedure approved by the Ministry of Energy of the Russian Federation, monthly, to the fifth number of the month following the calculated period, is an act on the volume of transmitted gas, which reflects the daily volume of gas transmission.

29. Gas prices and its transportation rates are indicated in relevant treaties in accordance with the legislation of the Russian Federation and the regulatory legal acts of the federal executive authorities.
30. Supply and gas selection are carried out exclusively on a reimbursable basis in accordance with the contract concluded.
The procedure for calculations and terms of payments are determined by gas supply agreements in accordance with these Rules.
In contracts under which suppliers are gas distribution organizations, the following mandatory conditions for gas settlements should be contained:

31. The terms of payment for gas transportation are determined by the gas transportation contract on the basis of tariffs for its transportation established in the manner defined by the federal executive bodies.

32. Parties are fulfilling contractual obligations in accordance with the Civil Code of the Russian Federation, other laws and legal acts of the Russian Federation and these Rules.

The gas distribution organization is obliged to immediately implement a complete limitation of gas supply to the consumer, whose networks have direct access to the networks of the specified gas distribution organization (gas transporter), in case of detection of an emergency and the threat of life and (or human health caused by the unsatisfactory state of the consumer's gasual equipment.

35. The supplier is obliged to ensure the quality of gas in accordance with regulatory requirements.
36. Gas odoring is made in accordance with regulatory and technical documentation.
37. The supplier, gas transmission and gas distribution organizations and the buyer are responsible in the prescribed manner responsibility for the technical condition of the gas supply facilities belonging to them and compliance with operational dispatch discipline.
38. The supplier, gas transmission and gas distribution organizations and the buyer are obliged to immediately communicate each other about accidents and faults at gas supply facilities leading to a violation of the supply regime or gas reception.
39. The gas distribution organization submits at the request of the supplier operational information on gas consumption mode and payment status for supplied by buyers of gas.
40. The gas transmission organization is at the request of the gas distribution organization operational information on the volume and gas supply modes for each gas distribution station.
