The problem of lack of own housing is relevant for many Russian military personnel. To solve this problem, the state adopted a special law dedicated to the savings-mortgage system for providing housing for military personnel. This law allows military personnel serving in the Russian army not to wait, as before, to receive an apartment after completing their service, but to acquire the necessary housing much faster with the help of a mortgage and government support.

Participants in the state military mortgage lending program

By law, only some military personnel have the right to take advantage of the savings-mortgage system developed for the military.

Mandatory participation in the developed savings-mortgage program is provided for military personnel of the Republic of Armenia who entered into the first contract for military service in the Russian army after 01.01.2005, namely for:

  • graduates who graduated from higher military educational institutions;
  • midshipmen and warrant officers (with a contract duration of military service of 3 years)
    officers who were called up or entered voluntarily for military service in the Russian army from the reserve.

In addition, voluntary participation of the military in the savings-mortgage system developed by the state is also possible.   • graduates of higher military educational institutions who received their first military officer rank, starting from the beginning of 2005;
  • warrant officers and midshipmen whose duration of contract military service in the army will be 3 years, starting in January 2005.

To participate in the preferential military mortgage program, a serviceman must be entered into a special register of participants in the NIS.

This register is a list of persons participating in the state mortgage program for military personnel, indicating information about these participants. Federal legislation determines that the formation and maintenance of such a register of military personnel participating in the savings and mortgage state system falls within the competence of federal executive authorities, in which Russian legislation provides for military service.

As already mentioned, today both voluntary and mandatory inclusion in this register are possible. If a serviceman voluntarily expresses a desire to participate in the program, in order to be included in the register, he needs to write a corresponding report to the commander of the military unit in which he serves.

Inclusion in the register of military personnel occurs 10 days after Rosvoenipoteka receives the relevant lists from military units.

To include a military personnel in the list of those wishing to participate in the mortgage program, you must present:

  1. Application for participation;
  2. Passport of the military personnel applying for participation;
  3. A copy of the contract.

Mechanism for implementing the mortgage program

The main idea of ​​a military mortgage is to replace the state obligation to provide housing for military personnel with the issuance of financial resources for the purchase of this housing.

The state mortgage program for military personnel of the Republic of Armenia gives military personnel the opportunity to purchase an apartment or other housing using mortgage lending at any time after three years of participation of these persons in the savings-mortgage system. Thanks to this program, Russian military personnel receive their own housing without waiting for the end of their military service.

A serviceman included in the register becomes a participant in the mortgage program. After this, he has the right to count on receiving funded contributions from the state, which he can use only in strictly defined cases by the legislator.

Each military personnel participating in the savings-mortgage system opens a special personal savings mortgage account for the state to transfer monthly cash contributions.

Such transfers for military personnel are carried out at the expense of financial resources from the federal budget. The amount of funded contributions is determined by Russian legislation and is indexed annually. The amount of government contributions to be transferred to a military serviceman’s savings account is not affected by his military rank or the branch of the military in which he serves.

At the time of the introduction of the mortgage program for the military, the size of the financial contribution was set at 37,000 rubles per year, and in the current 2014 this contribution is already 233,100 rubles. Accounting and transfer of savings is carried out by the Federal Institution “Rosvoenipoteka”.

Today, there are several options for military personnel to receive accumulated financial resources:

  • after 20 years of military service in the Russian army;
  • after 10 years of service in the army upon dismissal, including dismissal when a serviceman reaches a certain age, is recognized for some reason as limitedly fit for military service or as a result of a reduction that has occurred;
  • at any time after 3 years of participation in the mortgage program for the military by obtaining a targeted housing loan provided to a military personnel who participated in the state mortgage program by Rosvoenipoteka.

Obviously, the accumulated amount in a serviceman’s personal account is not always enough to purchase his own home. Therefore, many military personnel turn to banks lending under the military mortgage program for the missing amount.

The procedure for purchasing housing under the mortgage program for military personnel is similar to conventional mortgage loans. The main difference is that in order to receive a bank mortgage, a serviceman must submit to the credit institution a certificate of participation in the savings-mortgage system.

To exercise his right to a military mortgage, a serviceman who meets the requirements for participants in the state program must:

  • get into the register of persons participating in the savings mortgage system;
  • after 3 years of participation in the mortgage program, submit a corresponding report to receive a special certificate confirming the right of a military member participating in the mortgage program to receive targeted loan funds for the purchase of housing;
  • receive this certificate;
  • select suitable residential property that meets the serviceman’s own requirements, as well as the requirements of the Russian Ministry of Defense, credit institution and insurance company;
  • apply for a mortgage from a bank that provides loans to military personnel;
  • open a special account and transfer available funds from the personal savings account to it, which will become the down payment;
  • wait for the bank’s decision and sign the mortgage agreement, which is drawn up between the military personnel participating in the preferential military mortgage program, the bank issuing the loan, and the Federal State Institution “Rosvoenipoteka”;
  • conclude an appropriate transaction for the purchase of housing;
  • obtain a registration certificate.

Documents for military mortgage

To obtain bank approval for mortgage lending, military personnel usually need the following documents:

  • certificate of a military personnel on the right of an NIS participant to housing mortgage lending;
  • military ID;
  • the identity card of the serviceman applying for a mortgage and the identity card of the spouse of the serviceman, if necessary - the passport of an authorized person who has a notarized power of attorney from the purchaser of the home;
  • certificates of marriage by a military personnel (divorce), birth certificates of children;
  • a certificate from the management company from the place of registration from the applicant-military and his family members;
  • certificate of TIN of the applicant-military;
  • certificate of education of a military personnel;
  • certificates from the place of service;
  • consent from the spouse - if the participant in the military mortgage is married;
  • power of attorney - if the serviceman is not personally present at the transaction.

The bank issuing a mortgage under the government program may require other documentation to approve the loan.

Basic program conditions

To summarize the above about the state program, we can highlight the main conditions for participation in a military mortgage:

  • the term of the contract for military personnel is of fundamental importance when participating in the mortgage program;
  • a serviceman can purchase housing with the help of state savings contributions no earlier than 3 years after concluding a contract;
  • a serviceman can himself determine the parameters of the purchased housing and the region in which it is purchased;
  • the maximum amount allocated by the state for the purchase of housing for a military man is 2.2 million rubles, and the minimum loan amount for a mortgage issued by a bank is 300,000 rubles. The size of a mortgage loan for military personnel depends on two factors: the size of the savings contribution available in the personal account of the military member of the NIS, and the term of the mortgage. All mortgage loans under the program are issued in ruble equivalent;
  • Mortgage loans for military personnel can be issued for a period from 3 to 25 years. The military mortgage loan must be repaid in full before the military borrower turns 45 years of age.

The first chapter of the federal law is traditionally devoted to general provisions. All laws according to which military personnel are provided with housing are briefly covered.

The emphasis is on the fact that all domestic legislation is primarily based on the norms of international law and the Constitution. In addition, the regulations of the Central Bank of the Russian Federation also play an important role.   12. The investment portfolio combines all securities and funds that are transferred to trust management on the basis of an agreement.
  13. There is also a so-called investment mandate, which lists all types of assets.
  14. The total investment portfolio combines all assets that are under trust management.

All these terms will be useful when concluding contracts and signing papers related to the savings-mortgage system for providing military housing. Each serviceman who logs into the system receives a personal registration number as a participant in the savings-mortgage system, and the funds are transferred to his personal account.

Implementation of the savings and mortgage system

The second chapter of the Federal Law is devoted directly to the implementation of the savings and mortgage system, thanks to which military personnel have the opportunity to improve their living conditions. We will focus only on the key points in order to imagine the order of implementation of the system.

The law determines how the implementation of the right to housing by a participant in the system is carried out. For this First, savings are formed, then a targeted housing loan is provided. Then the payment is made using federal budget funds. The funds must supplement the participant's savings account in the same way that the participant himself could accumulate money if his military service had already completed twenty years.

This payment is made only if the participant has not previously purchased residential premises using targeted housing loans. Therefore, this target program can only be used once.

Payments are made within three months from the date of submission of the application from the participant. The application must be submitted in writing. It can be submitted not only by the serviceman himself, but also by members of his family. When a person is included in the register, he receives a certificate of right to participate in the savings-mortgage system.

How savings are formed

The next chapter discusses in detail the mechanism of savings formation. The main sources of savings are income from investment, contributions from the federal budget and other revenues that are not prohibited by the legislation of the country.

All savings are strictly accounted for. A maximally transparent system has been created, during the operation of which it is impossible to misuse funds received from the budget. All this is done primarily in the interests of system participants - military personnel who want to improve their living conditions. Housing problems are being solved with the help of budget funds.

The functions of the federal bodies in which military service takes place are examined in detail. These bodies do the following:

  • maintain a register of participants, form it, send all the necessary information to the authorized federal body, in accordance with which savings accounts are maintained;
  • be sure to inform if a participant transfers to another federal body;
  • receive all information about participants;
  • compare data;
  • provide information on the number of participants;
  • provide information to the system participants themselves if they are included in the register or excluded from it;
  • decide whether to pay out funds;
  • explain to participants how the savings-mortgage system works;
  • perform other functions.

Functions of the authorized body

When this system is in effect, federal management of all processes is mandatory, since funds from the budget are used. It is also important to know the functions of the authorized federal body, which include:

  • accounting of all savings;
  • registration of receipt of funds by system participants;
  • holding competitions to select a specialized depository with the subsequent conclusion of an appropriate agreement;
  • holding competitions for the selection of management organizations;
  • preservation of savings of all system participants;
  • issuance of targeted loans with preliminary registration to participants after receiving relevant applications from them;
  • receiving funds from management organizations;
  • informing about all processes of formation, investment, and use of savings;
  • providing reports on the formation and use of savings to the Government of the Russian Federation annually;
  • informing all system participants about the situation on the housing market;
  • carrying out explanatory work with the population;
  • implementation of other functions provided for by law.

It is noteworthy that a public body is provided to control the operation of the savings and mortgage system for military personnel. A separate article of the law deals with the work of the Council. Representatives of federal executive bodies, public organizations, and securities market participants may be members of the Public Council. At the same time, those persons who make decisions on investing savings do not have the right to join the Council.

All members of the Council work for free. The Council has the right to send requests for investment, ask for various reports, contacting the Central Bank of the Russian Federation and the authorized federal body for this purpose.

Participation in the savings and mortgage system for the military

  4. If a person graduated from a military educational institution in the period from January 1, 2005 to January 1, 20078, and received an officer rank during training, he can also enter the system by expressing such a desire.
  5. Officers, both those who voluntarily entered service and those called up from the reserve, who entered into the first contract before January 1, 2005.
  6. Military personnel who received military rank after completing training courses for junior officers in the period from January 1, 2005, who served less than three years under a contract. If they received their first officer rank before January 1, 2008, they must confirm their desire to become participants in the system.
  7. If a person entered the service under a contract, and it provided for an officer rank according to the state, which he received on January 1, 2005, he also becomes a participant in the system. When the specified person received the rank of officer before January 1, 2008, his desire to enter the system must be confirmed.
  8. Persons who became officers after being appointed to a military position for which the rank of officer was provided for by the state, and who served under a contract for less than three years, can also, if they wish, become participants in the savings-mortgage system.

Formation of a register of system participants: inclusion and exclusion

It is important to know on what basis they can include participants in the register, which becomes the reason for exclusion from it.

Receiving the first military rank of an officer becomes the reason for inclusion in the register for the following categories:

  • Military personnel who entered service under a contract, where an officer rank was provided in the state. The period is considered to be from January 1, 2008.
  • Persons who graduated from military educational organizations, both higher and professional, and in the period after January 1, 2005, entered into the first contract for military service.
  • Military personnel who have completed junior officer training courses and subsequently received the rank of officer. The period is considered from January 1, 2008.

The following categories of military personnel need to submit a written application with a request to be included in the register of participants:

  • Midshipmen, warrant officers who have served under a contract for three years since January 1, 2005, if the first contract was concluded before the designated period.
  • If a person became an officer in the process of training, and received military education in the period from January 1, 2005 to January 1, 2008.
  • Persons who received military education between January 1, 2005 and before the onset of this period entered into a contract for military service.
  • Petty officers and sailors, sergeants and soldiers.
  • Military personnel who received ranks after appointment to a position where the officer rank is provided for by the state. The period from January 1, 2005 to January 1, 2008 is considered.
  • Persons who received the rank while serving under a contract and entering a position where the officer rank provides for staff. The period from January 1, 2005 to January 1, 2008 is considered.
  • If the military during the same period, from 2005 to 2008, became officers after completing junior officer training courses.

There are other reasons why military personnel are included in the register of participants in the savings-mortgage system.

Some military personnel voluntarily leave the reserves and enter service. If they were not excluded from the register and did not receive payments, they only need to conclude a new service contract in order to again receive all the rights of a participant in the system.

If military personnel returned to service from the reserve voluntarily, but before that they received payment and were excluded from the register, the basis for re-inclusion may be a total duration of service of more than 20 years.

If midshipmen and warrant officers entered into their first military contract after January 1, 2005, but managed to serve for more than three years, they also have the right to become participants in the system.

For officers who entered the service voluntarily or called up for service, it is enough to conclude the first contract for military service.

Exclusion from the registry

Those who retire from military service are excluded from the register of system participants. Of course, all persons whom the state has already provided with living quarters cease to be participants.

It is important to note that housing from a specialized housing stock is an exception.

Also, persons who are declared dead or missing are excluded from the register.

Using savings in the account

Funds from the personal savings account of a system participant can be used in some cases. The entire amount remains available under certain conditions. This possibility arises if the total period of military service of the person was twenty or more years.

If a military man retires after ten years for health reasons, due to reaching the age limit for service, for health reasons or due to organizational and staffing measures, he also has the right to use savings. In addition, funds are used when a military man is discharged for health reasons, declared dead or missing.

Another nuance that is worth paying attention to is the validity period of the NIS certificate. It is only 6 months from the date of signing.

Rosvoenipoteka explained that insurance payments are the responsibility of a citizen and are in no way related to NIS. "This is a requirement of the law on mortgages. Any citizen of the Russian Federation, when registering a residential premises under a mortgage lending agreement, is obliged to insure the property and enter into a property insurance agreement for the living space. Even if you take out a regular mortgage loan, you are required to enter into a property insurance agreement, since you are the user of the collateral, which may be lost. The amount of savings does not depend on the size of the family

Another feature of the program is that the amount of savings under the NIS does not depend on the number of family members of the serviceman. For a large family with 2 - 3 children this can be a problem. In order not to have four people sharing a one-room apartment, you will have to pay extra out of your own pocket, if, of course, you can find something.

Registration of documents at the bank may take more than one month

Despite the fact that the program has been developed and is widely implemented throughout the Russian Federation, paperwork at the bank can take several months. The total duration of approval and execution of all necessary documents at the bank can reach 2 - 4 months.

Indexation of annual accruals to NIS participants

Let's return to the annual charges to the NIS participant's account, which go towards repaying the mortgage. According to the military, the bank initially plans to increase annual payments. But no one knows for sure whether the indexation of the annual accrual to the NIS participant’s account will correspond to an increase in the amount of payments, and, therefore, it is quite possible that the military will have to repay the difference at his own expense. The fact that in 2016 the savings contribution was not indexed, although in 2008-2015 the amount was indexed annually, also raises doubts.

Rosvoenipoteka emphasized that such a situation cannot arise. Payments are made in accordance with the schedule approved when applying for the loan. “The amount paid by the state is approved annually by the Federal Budget Law. The state pays 1/12 of this amount monthly. The bank calculates the payment based on the amount established in the budget,” the interlocutor clarified.

It's easy to lose your apartment

Perhaps the most important risk when buying housing under the military mortgage program is the fact that a military man can easily lose his apartment upon early dismissal from service, even if the dismissal occurred for reasons beyond his control (for example, due to the disbandment of a unit).
Upon dismissal with less than 10 years of service, the NIS participant must return all CZHZ funds previously allocated to him for the purchase of housing from his own pocket, and repay the remaining loan himself. The presence of preferential grounds will not play any role in this case. Moreover, the money must be returned no later than 10 years from the date of dismissal, taking into account interest equal to the refinancing rate.

Otherwise, both the bank and Rosvoenipoteka will demand money in court, and if the military man is unable to repay the debt, they will take away the housing that is double-collateralized. If a serviceman contributed his own funds when purchasing an apartment, no one will return them if the contract is terminated early.

If the serviceman’s service is more than 10 but less than 20 years, then the used savings funds remain with the serviceman, however, the NIS participant pays the rest of the loan independently.


If a military man with more than 10 years of service is dismissed on preferential terms, then he has no financial obligations to the bank - the state will pay off the mortgage. “Good” grounds for dismissal may include reduction of military unit, health problems, or reaching the age limit of 45 years.

Upon dismissal with more than 20 years of service, CZHZ funds are not refundable. True, there is one nuance here, which one of the agency’s interlocutors drew attention to: if at the time of registration of a military mortgage the serviceman had only 10 years left before retirement (until he reaches 20 years of service), and the mortgage is designed for 12 years, then payments from budget fully covered the mortgage, the military man will need to serve two more years beyond his term.

If a military man with 20 years of service has not used NIS funds, he receives the right to use personal savings at his own discretion.

Additional documents from the spouse

In the case of adding their own funds, the spouse of a military member participating in the NIS may be required to provide additional documents, namely a notarized statement stating that the money additionally paid by the military family is not jointly acquired property.

This is due to the fact that during a divorce, an ex-military spouse often manages to achieve the division of an apartment purchased with a military mortgage. Although the official website of Rosvoenipoteka specifically emphasizes that the common property of spouses does not include payments for a special purpose or housing purchased with these payments, the court often issues similar claims.

Thus, if an NIS participant fails to comply with the terms of the program, his spouse will not be able to claim the collateral property, that is, the purchased apartment.

The NIS was introduced in 2005, when the relevant law came into force. In 2007, the system of providing mortgage loans to military personnel was implemented and finalized on an experimental basis.

How to become a participant in the program? The system applies to persons who have Russian citizenship, are in contract military service and are included in the register. The order of formation of lists is regulated.

Conditions for participation in the system

  2. For citizens called up to serve from the reserve, it is necessary to conclude a service contract.
  3. For midshipmen and warrant officers who began service after 01/01/2005, a certain period of conduct of this activity is required, equal to three years.
  4. For foremen, sergeants, and soldiers, participation in the program is carried out upon concluding a second contract after 01/01/2005.

Citizen excluded from the program on the following grounds:

  • termination of military service;

When a citizen is transferred from one unit to another, which also provides for military service, his status in the system and savings are preserved. The presence of real estate is not a basis for excluding a citizen from the register.

  • as a down payment for the purchase of real estate;
  • use of the available amount for other purposes.

In order to use funds not for the purchase of residential space, but for other purposes, the following conditions must be met:

  1. Duration of service during 20 years and more.

The NIS is valid for the entire duration of the citizen’s service. The loan term depends on the banking organization. The minimum period is usually 36 months.
