The nuances of scheduling working hours

  • determine the norm of working time for this group of workers: 247 working days × 4.8 hours - 6 hours of pre-holiday shortcomings = 1,179.6 hours.

For the rest of the employees of this company, when working in the five-day mode, the norm of working time will be: 8 hours × 247 working days - 6 hours = 1,970 hours.

IMPORTANT! The norm of working time is reduced by the total length of breaks in the performance of labor functions: vacations, sick days, donor days and other similar time periods when the employee is not working.

Shift work as a type of employment under the Labor Code of the Russian Federation

Shift schedule, limitations of its application

The shift schedule is a local regulatory act that determines the working conditions of workers who work in shifts.   • daily and weekly rest time;

When drawing up a shift schedule, labor law analysts propose to be guided by the current provisions of the Guidelines for the organization of multi-shift work of industrial associations (enterprises) of industry, approved by the USSR State Labor Committee (Moscow, 1988).

In the example above, it is logical and efficient to use the shift schedule of 4 teams that work in the following mode: 3 teams provide a work process around the clock in 3 shifts of 8 hours, the fourth one has a rest.

IMPORTANT! If the employment contract with the employee contains a condition on shift work, the employer is obliged to notify him of the shift schedule for the next accounting period at least a month before its start (Article 103 of the Labor Code of the Russian Federation).

Labor legislation, protecting the rights of the employee, introduces certain restrictions on the use of labor in the evening and at night and, as, indeed, with any mode of working time, requires an established ratio of work and rest time.

The Labor Code of the Russian Federation establishes the following restrictions:

  • Art. 103 prohibits the involvement of 2 shifts in a row;

Norm of hours for shift work, summarized accounting of working time

Labor legislation normalizes the normal duration of the working week - no more than 40 hours in the general case. A shorter week and a shorter duration of daily work are enshrined in the Labor Code of the Russian Federation for certain groups of workers due to their age, health status, training, and employment at work with harmful or dangerous working conditions (Articles 92, 94 of the Labor Code of the Russian Federation). These standards are generally applicable, including for shift work.

However, it is often difficult for employers who practice shift work of workers to maintain the principle of a normal working week of no more than 40 hours. This is due to the specifics of the production process. In this case, Art. 94 of the Labor Code of the Russian Federation allows the employer to use the summarized accounting of working hours.

When calculating hours worked, a month, quarter or year is taken as the base period. This period for calculating the number of working hours is called accounting. The time spent by the employee on the performance of labor duties in the accounting period should not exceed the normal number of hours of the working week, a multiple of the number of weeks.

The Labor Code of the Russian Federation limits the duration of the accounting period: it cannot be more than 1 year. Types of shift schedules

Depending on the technology of the company's work, shift schedules with different durations and a combination of working periods of time with periods of rest can be established for different positions.

For example, for workers in such a specific area as railway transport, schedules can be developed with the following parameters:

  • day and night shifts, rest after night work and a day off, followed by a new work shift;
  • 2 working days of 11 hours each (without work at night) alternate with two consecutive days of rest;
  • work shifts are combined with rest in the following combination: a working day after three days of rest.

The first form of shift work is typical for operators on duty at the station, inspectors-repairers of cars, mechanics for the repair of rolling stock and other workers who provide round-the-clock reception, passage and processing of rolling stock.

The specifics of the activities of workers of the second group do not require a round-the-clock presence at the workplace, however, it does not allow any breaks in daytime work shifts. Remuneration for shift work: nuances

The calculation of wages for a shift worker is specific in that the number of working hours according to the schedule may differ from the norm upwards (planned overtime work) or form a planned gap.

In accordance with clause 5.5 of the Decree of the State Committee for Labor of the USSR No. 162 of May 30, 1985, the All-Union Central Council of Trade Unions No. 12-55, processing is payable in one and a half (the first 2 hours that fall on average on each working day of the accounting period) and double the amount (subsequent hours of work).

A similar approach to paying overtime was confirmed by the Supreme Court of the Russian Federation (Section 5 of the review approved by the Presidium of the Supreme Court of the Russian Federation on February 26, 2014).

The operational dispatcher has a summarized accounting of working hours with an accounting period of 1 month. Work is carried out according to schedule 2/2 (2 working days for 11 hours after 2 days off).

According to the schedule for the month, the dispatcher worked 165 hours at a rate of 160 hours. The accountant made the following calculation (the dispatcher's hourly rate is 260 rubles):

  • salary for hours worked: 165 hours × 260 rubles / hour = 42,900 rubles;
  • processing hours: 165 - 160 = 5 hours;
  • number of working days in the accounting period: 165 hours / 11 hours per shift = 15 days;
  • calculation coefficient (average duration of overtime work per 1 working day of the accounting period): 5 hours / 15 days. = 0.33 h/day. (does not exceed 2 hours a day, which corresponds to the payment of hours of processing in one and a half times);
  • the amount of additional payment for overtime work: 260 rubles per hour × 5 hours × (1.5 - 1) = 650 rubles;
  • total salary: 42,900 + 650 = 43,550 rubles.

With the same approach, you can calculate in a different way:

  • salary for the norm of hours: 160 hours × 260 rubles / hour = 41,600 rubles;
  • surcharge for processing: 5 hours × 260 rubles / hour × 1.5 = 1,950 rubles;
  • total salary: 41,600 + 1,950 = 43,550 rubles.

The choice of calculation method does not affect the final result.

Holiday salary supplements for shift workers

With regard to the payment of holidays that fell on work shifts, the general procedure established by labor legislation applies.

Important! In accordance with Art. 153 of the Labor Code of the Russian Federation, work on holidays is paid at least double the amount. Holiday non-working days are listed in Art. 112 of the Labor Code of the Russian Federation.

Following the legally defined minimum level of holiday surcharges, the employer has the right to set its own amount of such surcharges. Their maximum limit is not regulated by law. The procedure for paying holidays, like all other important nuances of payroll calculations, must be reflected in the internal local act of the company (collective agreement, regulation on wages, etc.).

When calculating the salary of a shift worker, provided that in the billing month his work shifts coincided with public holidays, the following must be taken into account:

  • if an employee starts a shift at 8:00 am on a holiday and his shift lasts 11 working hours, all hours actually worked are subject to a holiday surcharge in full;
  • if part of the work shift falls on the night period (for example, from 20:00 on a holiday until the morning of the next day), the calculation of the holiday surcharge must be made only until 24:00 on a holiday (in this case, 4 hours) - from 20:00 to 24:00 :00 holiday.

The employer needs to correctly calculate the duration of work shifts and rest breaks, draw up a shift schedule, familiarize employees with it in a timely manner, keep records of the time actually worked by employees, and then competently calculate wages, taking into account the peculiarities of shift work.
