However, any freelancer who works remotely, communicating with a client via the Internet, becomes a “freelancer.” For some reason, many people believe that this type of employment is primarily the domain of IT specialists, although, in addition to programmers and designers, journalists and teachers also work remotely, and even doctors give consultations. The flywheel is gaining momentum and freelancing, which allows you to easily find employers around the world, is preferred by more and more people.

The specificity of freelancing, in addition to searching for orders on specialized exchanges, is that the employer transfers payment in any non-cash form that does not require personal contact. Moreover, any currencies, bank accounts, electronic wallets in various systems can be used - as agreed. Yes, and with all this, the relationship between the customer and the freelancer is not formalized in any way.

But what about freelance taxes? After all, sooner or later everyone will still have to think about this question. Receiving income involves entrepreneurial activity, on which taxes must be paid. However, there are a number of points here. Firstly, freelancing can be recognized as a business activity only if an individual receives income from it on a regular basis. Rare, one-time payments are not such.

Secondly, let’s be honest, at the moment, no effective methods for monitoring and collecting taxes from freelancing have been developed either in Russia (the site “All about Payoneer in Russia”), or in Ukraine, or in Kazakhstan. Everyone determines the work scheme independently, based on the specifics of the activity. The state, realizing that remote work implies an influx of funds into the country, and not vice versa, is not particularly active in the field of “hunting for freelancers.” Moreover, taxes are still collected from these funds directly and or indirectly.

However, you should always remember that tax evasion, that is, illegal business activity, without proper registration, entails administrative and sometimes criminal liability. Therefore, it is worth sorting out the question of whether to pay at all, and what taxes a freelancer pays.

If you don't pay at all

Many people do this - especially if remote work is not the main type of employment, and income from freelancing is small. Of course, from the point of view of the law, this is an obvious violation, but no one will come to you to check.

If there is no main place of work other than freelancing, problems may arise. Thus, a freelancer does not have contributions to the Pension Fund or other insurance contributions - with all the social insecurity that follows from this. In a bank, any institution, or a visa center, it’s somehow awkward to indicate “unemployed” - especially in this case, you would have to register with the employment center.

Much also depends on how exactly you receive funds. There are several options here.

  • A bank account in a Russian or Ukrainian bank - that is, a financial institution in the country where you live. Banks, as a rule, are not eager to provide information to the fiscal authorities, unless large sums are involved. For example, in the Russian Federation they are required to report you if more than 600 thousand rubles are withdrawn from your account one-time, or the amount of withdrawals during the year reaches 3 million. If funds come from abroad and your bank accepts them without problems (and some may require documents explaining the origin of the funds), then while the amounts are small, they are of no interest to the fiscal authorities. They may be interested in you only if the amounts regularly received are significant. Or, when checking a customer who is located in your country, his expenses will reveal information about the transfer of large sums to you.
  • Bank account in a foreign bank, electronic wallets. Information about the money that you receive into an account in a foreign bank - for example, using the most popular services Payoneer or ePayments - is completely inaccessible to your tax service. What are the consequences of not paying taxes?

There is no information yet about precedents for bringing freelancers to justice, especially more serious ones. But it’s worth having the information just in case. Non-payment of taxes (also known as tax evasion) can result in the following troubles.

  • fine plus collection of tax amount, but only for the period when your entrepreneurial activity is proven.
  • criminal penalty. This strict option only applies to cases in which large sums are involved and the damage to the state is assessed as “large” or “very large”.

If you report yourself

Despite the fact that Payoneer is an international payment system that allows you to accept payments from virtually all over the world and is one of the most popular and well-known global payment systems, its use is not very widespread in the Republic of Belarus.

Having analyzed the practice of using Payoneer in the Republic of Belarus, we can conclude that this payment system is extremely rarely used by legal entities and individual entrepreneurs due to the fact that most of them doubt its legitimacy and do not have information about what taxes should be paid in what order. pay when using it, and also do not fully understand what other nuances may arise in their work when using this system.

1. Permission from the National Bank of the Republic of Belarus

However, obtaining permission from the National Bank of the Republic of Belarus is not required, since Payoneer does not open accounts for clients.

It should be noted that from March 1, 2019, individuals are completely allowed to open any accounts abroad without the permission of the National Bank of the Republic of Belarus. For legal entities and individual entrepreneurs, the need to obtain a permit has not yet been canceled.

2. Value added tax

Belarusian companies join the offer and pay a commission to the American company Payoneer Inc., which is registered in the state of Delaware (USA). In accordance with paragraph 1 of Art. 114 of the Tax Code of the Republic of Belarus (hereinafter - TC), when selling goods (work, services) on the territory of the Republic of Belarus by foreign organizations that do not operate in the Republic of Belarus through a permanent representative office and are not registered in this regard with the tax authorities of the Republic of Belarus, The responsibility for calculating and transferring value added tax to the budget rests with organizations and individual entrepreneurs that are registered with the tax authorities of the Republic of Belarus and acquire these goods (works, services) and property rights.

The place of sale of works, services, property rights is determined in accordance with the provisions of Art. 117 NK. The place of provision of services by Payoneer Inc. Belarusian organizations and individual entrepreneurs do not recognize the territory of the Republic of Belarus; accordingly, Value added tax is not calculated.

3. Tax on income of foreign organizations not operating in the Republic of Belarus through a permanent representative office

The object of taxation of the income tax of foreign organizations that do not carry out activities in the Republic of Belarus through a permanent establishment is recognized as income received by the payer from sources in the Republic of Belarus, named in paragraph 1 of Art. 189 NK. Fees charged by Payoneer Inc. is not subject to income tax.

4. Offshore tax

According to the provisions of Art. 263 of the Tax Code, the object of offshore taxation is, inter alia, the transfer of funds by a resident of the Republic of Belarus to a non-resident of the Republic of Belarus registered in an offshore zone, another person under an obligation to this non-resident or to an account opened in an offshore zone, unless otherwise provided by this article .

The tax base of the offshore fee is determined based on the amount of funds written off. The offshore tax rate is 15%.

5. Mandatory sale of currency

Mandatory sale of foreign currency canceled from August 3, 2018(Decree of the President of the Republic of Belarus dated July 31, 2018 No. 301 “On the abolition of the mandatory sale of foreign currency”).

Legal entities and individual entrepreneurs have the right to leave on the account any foreign currency they receive, including those received by them using the Payoneer Inc. system.

6. Completion of foreign trade operations in accordance with Decree of the President of the Republic of Belarus dated March 27, 2008 No. 178 “On the procedure for conducting and monitoring foreign trade operations”

As a general rule, when exporting (transfer by a resident of goods (including in transactions not related to the movement of goods across the State Border of the Republic of Belarus), protected information, exclusive rights to the results of intellectual activity, performance of work, provision of services on a reimbursable basis to a non-resident) funds from the counterparty must be received within no more than 180 calendar days from the date of shipment of goods (transfer of protected information, exclusive rights to results of intellectual activity), performance of work, provision of services.

As a general rule, when exporting, a foreign trade transaction must be completed by receiving funds for the transferred goods (protected information, exclusive rights to the results of intellectual activity), work performed, services rendered. At the same time, funds are received only to the accounts of exporters (with the exception of a list of some fairly specific cases).

Thus, within 180 days from the date of shipment of goods (transfer of protected information, exclusive rights to the results of intellectual activity), performance of work, provision of services, funds must be withdrawn to the exporter’s account in the Republic of Belarus.

There are situations in which the counterparty does not sign a document confirming the provision of services, performance of work (act) or other document and a resident of the Republic of Belarus has no opportunity to oblige him to do so.

Such cases are regulated by the legislation of the Republic of Belarus, in particular, by the Resolution of the Board of the National Bank of the Republic of Belarus dated July 9, 2009 No. 101 “On foreign trade operations”, according to which the date of completion of work (provision of services, receipt or transfer of protected information, exclusive rights to results intellectual activity) in cases that do not provide for the signing by the parties to the foreign trade agreement of acts of work performed, services rendered, or other similar documents, the date is considered:

Payment of obligations of one of the parties indicated in the payment instruction or cash document;

Issuance of an invoice or invoice by one of the parties;

Preparation of postal receipts, courier receipts;

Issuance of a certificate (certificate, certificate, diploma) of obtaining an education (assigning a qualification, obtaining a specialty);

Carrying out a cultural or sporting event indicated on the ticket;

The card is delivered within 2-4 weeks(according to information from Payoneer). Sometimes it comes within a week, in the most problematic cases it takes a month or a month and a half. If the card has not arrived within this period, you can request that it be sent again (there is an option inside your account or you can write to support). They only resend a couple of times. If the card does not arrive again, you are out of luck, most likely the postal workers lose your letters (approximately 10% of cases) and then your only option is DHL delivery.
